AN ORDINANCE CALLING A SPECIAL MUNICIPAL ELECTION
TO BE HELD ON TUESDAY, JANUARY 23, 2024, AND
SUBMITTING TO THE REGISTERED ELECTORS OF THE CITY
OF PUEBLO THE CANDIDATES FOR THE MAYORAL RUNOFF
WHEREAS, in accordance with P.M.C. 17-2, should no Mayoral candidate receive a
majority of the votes cast, a special election is required to be called pursuant to Section 17-2 of
the Charter to allow the registered electors to select between the two top Mayoral candidates;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
At said Special Election, should it be required, there shall be submitted to a vote of the
registered electors two candidates for Mayor who received the highest number of votes for the
office at the November 7, 2023 General Election.
SECTION 2.
The City Council does hereby adopt the optional registration plan provided for in Section
17-9 of the Charter of the City of Pueblo and hereby determines and declares that voting
machines are not available.
SECTION 3.
All public notices that are required to be published with respect to the Special Municipal
Election shall be published in The Pueblo Chieftain.
SECTION 4.
The City Clerk, the Board of Elections, and all officers and staff of the City are authorized
to take all action necessary, appropriate or required to hold and conduct the special municipal
election, and officers and staff of the City are authorized to perform any and all acts consistent
with the intent of the Ordinance to effectuate the policies and procedures described herein.
SECTION 5.
If any section, clause or provision of this Ordinance shall for any reason be held to be
invalid or unenforceable, the invalidity or enforceability of such section, clause or provision shall
not affect any of the remaining sections, clauses or provisions of this Ordinance.
SECTION 6.
This Ordinance shall become effective immediately upon final passage.

SUMMARY:
This Ordinance calls for a Special Municipal Election to be held on Tuesday, January
23, 2024 to consider the candidates for the Mayoral Runoff.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
In accordance with P.M.C. 17-2, a qualified candidate for Mayor must receive a majority
of the votes cast for the office in the November 7, 2023 General Election. If no
candidate receives a majority of the votes cast, a special run-off election must be held,
with the two persons with the highest number of votes cast for the office appearing on
the ballot as candidates.
P.M.C. 5-3-3 declares that the Mayoral runoff election shall be conducted as a mail
ballot election.
FINANCIAL IMPLICATIONS:
The City’s estimated costs are projected at $300,000. Funding for the costs associated
with conducting this Special Municipal Election is allocated in the City Clerk’s 2024
Budget.
