AN ORDINANCE APPROVING A TIME EXTENSION FOR THE
RECORDING OF A VACATION PLAT FOR THE BLUFFS
MULTIFAMILY HOUSING DEVELOPMENT PROJECT AND
AMENDING ORDINANCE NUMBER 10322 TO CONFORM
THERETO
WHEREAS, Ordinance No. 10322 approved the vacation of portions of Pearl Street,
Burdette Avene, and Sumner Avenue with the condition that the vacation plat must be recorded
within one year of the date of approval of said Ordinance unless a time extension is granted by
an Ordinance of City Council; and
WHEREAS, the developer has requested a time extension for the period allowed to
record the vacation plat through December 31, 2024; and
WHEREAS, City staff have reviewed the developer's request and do not object to the
request; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Section 3 of Ordinance No. 10322 is amended to read as follows:
This Ordinance shall be approved but shall not become effective until the
final vacation plat is recorded in the office of the Pueblo County Clerk and
Recorder. If the vacation plat is not recorded on or before December 31, 2024,
or within any extended period granted by Ordinance of the City Council, this
Ordinance shall automatically be rescinded and repealed thirty (30) days after
written notice of such rescission and repeal is given to the applicant. No vested
rights shall accrue to the subdivision or be acquired until this Ordinance
becomes effective.
SECTION 2.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Ordinance to effectuate the policies and procedures described herein.
SECTION 3.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

NUMBER 10322 TO CONFORM THERETO
SUMMARY:
This Ordinance will extend the period allowed for recording the vacation plat approved
under Ordinance No. 10322 related to the Bluffs Multifamily Housing Development
project through December 31, 2024.
PREVIOUS COUNCIL ACTION:
Ordinance No. 10322, approved on November 17, 2022, approved a vacation plat
related to the development of the Bluffs Multifamily Housing Development and provided
a period of one year from the date that ordinance was approved to record the
associated vacation plat.
BACKGROUND:
The period granted for recording the vacation plat approved by Ordinance No. 10322
will be extended through December 31, 2024.
FINANCIAL IMPLICATIONS:
None.
BOARD/COMMISSION RECOMMENDATION:
Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
Not applicable to this Ordinance.
ALTERNATIVES:
Failure to approve this Ordinance will preclude the City from being able to record the
vacation plat that was approved under Ordinance No. 10322.
RECOMMENDATION:
Approval of the Ordinance.
