HomeMy WebLinkAbout10592ORDINANCE NO. 10592 AN ORDINANCE APPROVING AN AMENDMENT TO THE COOPERATIVE MAINTENANCE AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND PUEBLO SCHOOL DISTRICT NO. 60, RELATING TO THE MAINTENANCE OF CERTAIN PARK PROPERTIES, AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME WHEREAS, City and Pueblo School District No. 60 ("District") entered into the Cooperative Maintenance Agreement dated March 25, 2019 ("Agreement"), wherein the City agreed to maintain certain District property in exchange for District agreeing to maintain certain City property; and WHEREAS, upon mutual desire, the parties now wish to extend the term of the agreement for an additional ten years; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Amendment to the Cooperative Maintenance Agreement between the City of Pueblo, a Municipal Corporation, and Pueblo School District No. 60, relating to park maintenance of District property for neighborhood park purposes by the City. SECTION 2. The Mayor is hereby authorized to execute and deliver said Amendment on behalf of the City, and the City Clerk shall affix the Seal of the City thereto and attest the same. SECTION 3. The officers and staff of the City are authorized and directed to perform any and all acts consistent with this Ordinance and the attached Amendment to the Cooperative Maintenance Agreement to implement the transactions, policies, and procedures described herein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Steven Meier, Director of Parks and Recreation SUBJECT: AN ORDINANCE APPROVING AN AMENDMENT TO THE COOPERATIVE MAINTENANCE AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND PUEBLO SCHOOL DISTRICT NO. 60, RELATING TO THE MAINTENANCE OF CERTAIN PARK PROPERTIES, AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME SUMMARY: This Ordinance would approve an Amendment to the Cooperative Maintenance Agreement with Pueblo School District No. 60 to allow City to continue to maintain certain District 60 properties as City neighborhood parks. PREVIOUS COUNCIL ACTION: On March 25, 2019, City Council approved Ordinance 9438 which approved a Cooperation Maintenance Agreement between the City of Pueblo and Pueblo School District No. 60, relating to park maintenance of District 60 land for neighborhood park purposes by the City. BACKGROUND: Through a Cooperative Maintenance Agreement with Pueblo School District No. 60 from 2008 through 2018, the City maintained approximately 53.2 acres of District property as City Parks in exchange for 2.6 acres of District owned land where the City built Fire Station No. 9. On January 1, 2019, the entire 53.2 acres reverted back to the District for responsibility of maintenance of that property. Certain City parks are located on land owned by Pueblo School District No. 60. The three District park sites described in the Amendment total 21.9 acres, and is essential the City continue to maintain these properties due to their immediate proximity to existing City owned parks. In return, Pueblo School District No. 60 will continue to maintain 5.9 acres of City land, which consists of Little Heaton Park, which is located adjacent to Heaton Middle School. FINANCIAL IMPLICATIONS: The costs associated with the maintenance of the 21.9 acres of Pueblo School District No. 60 property will be accounted for through the Parks Department's annual maintenance and operating budget for the next ten (10) years. The 5.9 acre park known as Little Heaton Park will be maintained at the expense of Pueblo School District No. 60 during the same time frame. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Pueblo School District No. 60 supports this Ordinance. ALTERNATIVES: If this Ordinance is not approved, the maintenance of these neighborhood parks will be responsibility of Pueblo School District No. 60. RECOMMENDATION: Approval of the Ordinance.
