AN ORDINANCE ACCEPTING FUNDS IN THE AMOUNT OF
$16,742.00 FROM H.W. HOUSTON, LLC, A COLORADO
LIMITED LIABILITY COMPANY, FOR COSTS ASSOCIATED
WITH THE REPAIR OF W. 20TH STREET, AND BUDGETING
AND APPROPRIATING SAID FUNDS TO ACCOUNT CI2309 -
ROAD & STREET REPAIRS
WHEREAS, H.W. Houston Construction, LLC performed construction work on the Freed
Middle School campus in the Central Park neighborhood within the City of Pueblo and
operations related to that construction resulted in pavement damage to City roadways; AND
WHEREAS, H.W. Houston Construction, LLC has agreed to reimburse the City of
Pueblo for a portion of the cost to repair damaged pavement on W. 20th Street; NOW
THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Funds in the amount of $16,742.00 are accepted from H.W. Houston Construction, LLC.
SECTION 2.
Accepted funds in the amount of $16,742.00 shall be budgeted and appropriated to
Account No. CI2309 - Road & Street Repairs.
SECTION 3.
The officers and staff of the City are authorized to perform any and all acts consistent
with this Ordinance to implement the policies and procedures described herein.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

Introduced and initial adoption of Ordinance by City Council on October 23, 2023.
Final adoption of Ordinance by City Council on November 13, 2023.

SUMMARY:
The attached Ordinance will accept funds in the amount of $16,742.00 from H.W.
Houston Construction, LLC to cover a share of the cost associated with road repairs on
the segment of W. 20th Street between Freed Middle School and West Street. The
Ordinance also budgets and appropriates those funds into project account number
CI2309 - Road & Street Repairs.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
During a recent construction project at Freed Middle School, the pavement on W. 20th
Street was damaged due to heavy construction traffic. The segment of the road
between Freed Middle School and West Street will be repaired by the City and the
funds received from H.W. Houston are anticipated to cover approximately half of the
repair cost. While the existing pavement already showed some signs of deterioration,
the heavy construction traffic accelerated that damage and H.W. Houston has agreed
to reimburse the City for a portion of the repairs.
FINANCIAL IMPLICATIONS:
Funds in the amount of $16,742.00 will be budgeted and appropriated into project
account number CI2309 - Road & Street Repairs.
BOARD/COMMISSION RECOMMENDATION:
None.
STAKEHOLDER PROCESS:
None.
ALTERNATIVES:
Failure to approve this Ordinance will prevent the City from receiving the funds from
H.W. Houston Construction, LLC.
RECOMMENDATION:
Approval of the Ordinance.
