AN ORDINANCE APPROVING AN AGREEMENT FOR
PROFESSIONAL ENGINEERING SERVICES IN THE AMOUNT
OF $556,897.60 BETWEEN THE CITY OF PUEBLO, A
COLORADO MUNICIPAL CORPORATION, AND BROWN AND
CALDWELL, INC., FOR CONSULTING ENGINEERING AND
PROJECT MANAGEMENT SERVICES WITH RESPECT TO A
PILOT PROJECT TO IDENTIFY ISSUES CONTRIBUTING TO
GROUNDWATER INFILTRATION AND INFLOW TO THE CITY’S
SEWER SANITARY SYSTEM AND AUTHORIZING THE MAYOR
TO EXECUTE THE SAME
WHEREAS, the Pueblo Wastewater Department operates a Water Reclamation Facility
and collection system providing municipal wastewater treatment;
WHEREAS, consulting engineering services with respect to the design required for
consulting engineering services relating to a pilot project to identify issues contributing to
groundwater infiltration and inflow to the city’s sewer sanitary system and authorizing the mayor
to execute the same; and
WHEREAS, Brown and Caldwell is the consulting Engineer of Record and is the most
qualified to serve the Pueblo Wastewater Department for such project; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
An agreement by and between the City of Pueblo, a Colorado Municipal Corporation,
and Brown and Caldwell, Inc., a copy of which is attached hereto and made part hereof by
reference (“Agreement”), after having been approved as to form by the City Attorney, is hereby
approved.
SECTION 2.
Work Performed under the Agreement may include, but not limited to, the following
items:
1. Project management and administration;
2. Field investigation, data analysis, condition assessment, and reporting services; Field
service preparation for a pilot project.
SECTION 3.
The Mayor is hereby authorized to execute said Agreement on behalf of Pueblo, a
Colorado Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and
attest the same.
SECTION 4.
Funds for work performed under this agreement shall be from the Sewer User Fund
Project No. WW1503.
SECTION 5.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Ordinance and the Agreement approved to implement the transactions
described therein.
SECTION 6.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
This Ordinance accepts an agreement between the City of Pueblo and Brown and
Caldwell, Inc. for consulting engineering services relating to a pilot project to identify
issues contributing to groundwater infiltration and inflow to the city’s sewer sanitary
system and authorizing the mayor to execute the same.
PREVIOUS COUNCIL ACTION:
On November 12, 2018, the City Council Approved Resolution No. 14081, selecting
Brown and Caldwell, Inc as the Engineer of Record for the Wastewater Treatment
Department.
BACKGROUND:
The Wastewater Department has been addressing selenium and sulfate issues in the
Arkansas River Basin for more than 25 years. Naturally occurring selenium and sulfate
are known to enter the city sewer collection system through the infiltration and inflow of
groundwater. The sanitary sewer collection system conveys sewage and the
groundwater to the James R. DiIorio Water Reclamation Facility. Approximately 50
percent of the selenium and very little sulfate is removed during the treatment process.
The purpose of this project is to pilot multiple technologies in geographical locations
with groundwater high in selenium and sulfate. These technologies, not previously
used by the Wastewater Department, are capable of identifying and locating sources of
groundwater infiltration and inflow entering the sanitary sewer collection system.
FINANCIAL IMPLICATIONS:
The cost of the agreement with Brown and Caldwell to provide design services for the
rehabilitation project will not exceed $556,897.60. Funds are available from the Sewer
User Fund and have been appropriated to Project No. WW1503.

ALTERNATIVES:
The no-action alternative will eliminate the opportunity to collect data that identifies
where infiltration and inflow occur in the sanitary sewer collection system. Without this
data, it is unknown how best to rehabilitate the sanitary sewer mains to stop infiltration
and inflow containing selenium and sulfate.
RECOMMENDATION:
Approval of the Ordinance.
