HomeMy WebLinkAbout10488ORDINANCE NO. 10488 AN ORDINANCE ESTABLISHING ACCOUNT PROJECT CI2320 - FIRE STATION NO. 6 LAND PROCUREMENT, TRANSFERRING $70,000 FROM THE UNAPPROPRIATED FUND BALANCE OF THE GENERAL FUND, BUDGETING AND APPROPRIATING SAID FUNDS IN THE AMOUNT OF $70,000 TO ACCOUNT PROJECT NO. CI2320, AND APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT TO BUY AND SELL REAL ESTATE FOR A PORTION OF LOTS 7 AND 8, BLOCK 2, TRINITY SUBDIVISION, CITY OF PUEBLO COLORADO BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Fire Station No. 6 Land Procurement project, account tProject No. CI2320, is hereby established. SECTION 2. Funds in the amount of $70,000.00 are hereby transferred from the unappropriated fund balance of the General Fund and budgeted and appropriated into the Fire Station No. 6 Land Procurement account Project No. CI2320. SECTION 3. The Contract to Buy and Sell Real Estate between the City of Pueblo, a Colorado Municipal Corporation, and Global Proposal, LLC., a copy of which is attached hereto ("Agreement"), having been approved as to form by the City Attorney, is hereby approved. The Mayor is authorized to execute and deliver said Agreement in the name of the City of Pueblo. The City Clerk is authorized to affix the seal of the City thereto and attest same. SECTION 4. The officers of the City are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Action by City Council: Introduced and initial adoption of Ordinance by City Council on June 12, 2023. CI2320, AND APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT TO BUY AND SELL REAL ESTATE FOR A PORTION OF LOTS 7 AND 8, BLOCK 2, TRINITY SUBDIVISION, CITY OF PUEBLO COLORADO SUMMARY: This Emergency Ordinance establishes account Project No. CI2320 - Fire Station No. 6 Land Procurement, transfers $70,000.00 from the unappropriated fund balance of the General Fund, budgets and appropriates total funds in the amount of $70,000.00 into the newly-created project account, and approves and authorizes the Mayor to execute a contract to buy and sell real property (specifically, portions of Lots 7 and 8 of Block 2 of the Trinity Subdivision in the City of Pueblo. PREVIOUS COUNCIL ACTION: None. BACKGROUND: This Emergency Ordinance establishes a project account designated specifically for the procurement of additional land to support the ongoing project to design and construct the new Fire Station No. 6 on Victory Lane on the City's east side. During the design process, it became apparent that the configuration of the lots owned by the City of Pueblo did not have sufficient depth to accommodate a driveway that would allow fire apparatus to pull through the vehicle bay. An additional area of approximately 0.85 acres will be required to construct the new fire station. The City of Pueblo is prepared to enter into an agreement to purchase the property and this Ordinance will also approve the Mayor to execute the agreement on behalf of the City of Pueblo. FINANCIAL IMPLICATIONS: Funds in the amount of $70,000.00 shall be transferred from the unappropriated fund balance of the General Fund and budgeted and appropriated into the newly-created account Project No. CI2320 - Fire Station No. 6 Land Procurement. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: Failure to approve this Emergency Ordinance will prevent the procurement of the additional parcel necessary to design and construct the pull-through access driveway at Fire Station No. 6.
