HomeMy WebLinkAbout10581ORDINANCE NO. 10581 AN ORDINANCE APPROVING A SUBRECIPIENT AGREEMENT AUTHORIZING PAYMENT IN AN AMOUNT OF UP TO $400,000 OF COMMUNITY DEVELOPMENT BLOCK GRANT – COVID-19 FUNDS TO THE PUEBLO RESCUE MISSION THROUGH A SUBRECIPIENT AGREEMENT TO PURCHASE REAL PROPERTY LOCATED AT 710 WEST 4TH STREET, PUEBLO, CO AND MAKE CERTAIN IMPROVEMENTS TO THE PROPERTY TO PROVIDE A WARMING SHELTER FOR THE PUEBLO COMMUNITY DURING WEATHER EMERGENCIES DECLARED BY THE CITY AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Subrecipient Agreement (“Agreement”) between Pueblo, a municipal corporation and Pueblo Rescue Mission, attached hereto, and the Award of CDBG-CV funds is hereby approved. SECTION 2. After the Agreement is approved as to form by the Department of Law, the Mayor is hereby authorized to execute said Agreement for and on behalf of the City and the City Clerk is authorized to affix the seal of the City thereto and attest same. SECTION 3. Funds for this Agreement shall be paid from available CDBG-CV Funds, Project CDCV- 070. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance and the attached Agreement to implement the policies and procedures described therein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Laura Solano, Chief of Staff SUBJECT: AN ORDINANCE APPROVING A SUBRECIPIENT AGREEMENT AUTHORIZING PAYMENT IN AN AMOUNT OF UP TO $400,000 OF COMMUNITY DEVELOPMENT BLOCK GRANT – COVID-19 FUNDS TO THE PUEBLO RESCUE MISSION THROUGH A SUBRECIPIENT AGREEMENT TO PURCHASE REAL PROPERTY LOCATED AT 710 WEST 4TH STREET, PUEBLO, CO AND MAKE CERTAIN IMPROVEMENTS TO THE PROPERTY TO PROVIDE A WARMING SHELTER FOR THE PUEBLO COMMUNITY DURING WEATHER EMERGENCIES DECLARED BY THE CITY AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME SUMMARY: This ordinance authorizes the transfer of funds in the amount of up to $400,000 from the City’s available Community Development Block Grant – COVID-19 Funds to the Pueblo Rescue Mission through a subrecipient agreement to purchase real property and make necessary improvements required to operate the real property as a warming shelter for the Pueblo community during weather emergencies declared by the City. This payment is authorized by under Title I of the Housing and Community Development Act of 1974, as amended (HCD Act), Public Law 93- 383, and 24 C.F.R. § 570.208. . PREVIOUS COUNCIL ACTION: By Ordinance No. 9951, approved June 14, 2021, the City Council approved and adopted the City of Pueblo FY2020 Action Plan for listing projects and programs for funding from CDBG, CDBG-CV, and HOME federal funds. On October 10, 2023, the City Council approved and adopted an ordinance to amend the FY2020 Action Plan to include the expenditure of CDBG-CV funds for the purchase of property to facilitate the operation of a warming shelter within the City. BACKGROUND: March 27, 2020, President Trump signed the Coronavirus Aid, Relief, and Economic Security Act (Public Law 116-136) (CARES Act), which makes available $5 billion in CDBG coronavirus response (CDBG-CV) funds to prevent, prepare for, and respond to coronavirus. City has applied for and received Community Development Block Grant CARES Act (CDBG-CV) funds from the United States Government under Title I of the Housing and Community Development Act of 1974, as amended (HCD Act), Public Law 93- 383. The Pueblo Rescue Mission supports, empowers, and provides high-quality resources to the Pueblo community in a safe and secure environment. It provides services that increase access to stable housing, food, physical and mental health care, addiction support services, and wellness resources intended for improved quality of life for the Pueblo Community; and The effects of COVID-19 have negatively impacted local employment, increased the number of evictions, and resulted in an increased number of homeless individuals and families in our community. Acquiring additional shelter space within the City will allow the City of Pueblo to prepare for future emergencies, expand its shelter capacity, and allow the city to isolate the spread of illness within the shelter population and increase the ability to respond to future emergencies should there be a need to administer aid. FINANCIAL IMPLICATIONS: Funding for this project will be paid out of available CDBG-CV Funds, Project CDCV- 070 in accordance with the City’s amended FY2020 Action Plan. BOARD/COMMISSION RECOMMENDATION: The Citizens Advisory Committee heard a presentation on the project during the July 18, 2023 CDBG Presentations Hearing. The CAC reviewed and ranked the project during this CDBG funding cycle. STAKEHOLDER PROCESS: None ALTERNATIVES: City Council could not authorize payment for the purchase of the real property and improvements necessary to operate a warming shelter within the City of Pueblo.
