HomeMy WebLinkAbout10579ORDINANCE NO. 10579 AN ORDINANCE ACCEPTING A BARGAIN AND SALE DEED FROM PUEBLO HISTORICAL AIRCRAFT SOCIETY, A COLORADO NONPROFIT, FOR A HANGAR LOCATED AT 508 SKYWAY STREET AT THE PUEBLO MEMORIAL AIRPORT, AND AUTHORIZING THE MAYOR TO EXECUTE SAME. BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Pueblo Historical Aircraft Society built a hangar at 508 Skyway Street and would like to convey deeded ownership of the building to the City of Pueblo, a Colorado Municipal Corporation, and the acceptance of the structure is hereby approved. SECTION 2. The Mayor is authorized to execute and accept ownership in the name of the City and the City Clerk is authorized to affix the seal of the City thereto and to attest same. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance and the attached Amendment which are necessary or desirable to conduct the transactions described therein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Greg Pedroza, Director Aviation SUBJECT: AN ORDINANCE ACCEPTING A BARGAIN AND SALE DEED FROM PUEBLO HISTORICAL AIRCRAFT SOCIETY, A COLORADO NONPROFIT, FOR A HANGAR LOCATED AT 508 SKYWAY STREET AT THE PUEBLO MEMORIAL AIRPORT, AND AUTHORIZING THE MAYOR TO EXECUTE SAME. SUMMARY: Attached is an Ordinance approving and authorizing the Mayor to accept ownership of the annex hangar building (the “Annex”) located at 508 Skyway Street, adjacent to the Museum premises. The Annex is to be used for the restoration of aircraft and other equipment by the Pueblo Historical Aircraft Society (“PHAS”), a Colorado nonprofit corporation through an Amendment of the Management Agreement for the Pueblo Weisbrod Aircraft Museum. PREVIOUS COUNCIL ACTION: In 2017, Council approved an Agreement to Manage the Pueblo Weisbrod Aircraft Museum. BACKGROUND: In 2021, Pueblo Historical Aircraft Society proposed building an annex building at the Pueblo Memorial Airport for the express purpose of restoring aircraft for display at the museum. The Annex construction would be entirely funded by PHAS. On July 14, 2021, the Pueblo Planning and Zoning Commission reviewed and approved the building. The building was constructed and completed. FINANCIAL IMPLICATIONS: Approval of this Ordinance would clarify that the Annex belongs to the City, and that it may be used by The Pueblo Historical Aircraft Society. Total invoiced cost of the project was $1,175,976.45, paid by the Society. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: If this Ordinance is not approved, the City will obtain ownership of the Annex hangar through legal action and by operation of law. RECOMMENDATION: The Department of Aviation recommends approval of this Ordinance. ATTACHMENTS: None
