AN ORDINANCE APPROVING AN AMENDMENT TO THE
RENTAL AGREEMENT FOR THE USE OF AN OFFICE SPACE
AND THE FIRE FIGHTING RELOAD BASE AT THE PUEBLO
MEMORIAL AIRPORT BETWEEN THE CITY OF PUEBLO, A
COLORADO MUNICIPAL CORPORATION, AND THE STATE OF
COLORADO DEPARTMENT OF PUBLIC SAFETY, DIVISION OF
FIRE PREVENTION AND CONTROL, AND AUTHORIZING THE
MAYOR TO EXECUTE THE SAME.
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Standard Lease Amendment \[Improved Real Property\] (“Lease”), by and between
the City of Pueblo, a Colorado Municipal Corporation, and the State of Colorado Department of
Public Safety, Division of Fire Prevention and Control, to lease office space at 31501 Bryan
Circle, Suite 110, 524 Cherokee Lane, and parking apron at 31851 Bryan Circle at Pueblo
Memorial Airport, a copy of which is attached hereto and made a part hereof by reference, after
having been approved as to form by the City Attorney, is hereby approved.
SECTION 2.
The Mayor is hereby authorized to execute the Lease in the name and on behalf of the
City of Pueblo, where the Mayor may execute the Lease by electronic signature and such
electronic signature shall be attributable to the Mayor and the City of Pueblo.
SECTION 3.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Ordinance and the attached Lease to effectuate the terms and conditions
described therein.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUBJECT: AN ORDINANCE APPROVING AN AMENDMENT TO THE RENTAL
AGREEMENT FOR THE USE OF AN OFFICE SPACE AND THE FIRE
FIGHTING RELOAD BASE AT THE PUEBLO MEMORIAL AIRPORT
BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL
CORPORATION, AND THE STATE OF COLORADO DEPARTMENT OF
PUBLIC SAFETY, DIVISION OF FIRE PREVENTION AND CONTROL,
AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME.
SUMMARY:
The State of Colorado Department of Public Safety, Division of Fire Prevention and
Control, (“State”) is desirous of extending their lease existing office space of
approximately 1,400 square feet and the Fire Fighting Reload Base, also known as the
tanker base reload pit, (“Base”) at the Pueblo Memorial Airport and adding additional via
an Amendment at 524 Cherokee Lane, Pueblo, CO 81001 (the "Building"), comprised of
Eight Hundred and Ninety-Three (893) rentable square feet, as well as relating to the
leasing portion of the building located at 31501 Bryan Circle, Suite 110, Pueblo,
Colorado 81001, (the “Building”), comprised of three hundred and fourteen (314)
rentable square feet, exclusive use parking apron for aircraft at 31851 Walt Bassett Ave,
Pueblo, Colorado 81001, (the Apron), consisting of twenty-one thousand (21,000) sq. ft.
PREVIOUS COUNCIL ACTION:
City Council approved the Lease Agreement through Ordinance 10243 on August 8,
2022.
BACKGROUND:
The City owns 31501 Bryan Circle (Hangar), 524 Cherokee Lane (“Building”) and 31851
Bryan Circle (Base/Apron). The hangar office space has been occupied by the
Colorado Division of Fire Prevention and Control since August 1, 2023. The Base is
used to reload airplanes with fire retardant during the fire season. The Base became the
property of the City on March 14, 2022.

Not applicable to this Ordinance.
BOARD/COMMISSION RECOMMENDATION:
Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
Not applicable to this Ordinance.
ALTERNATIVES:
If City Council does not approve this Ordinance, the additional space will not be added
to the leasehold.
RECOMMENDATION:
The Department of Aviation recommends the approval of this Ordinance.
