HomeMy WebLinkAbout10567ORDINANCE NO. 10567 AN ORDINANCE APPROVING AND ADOPTING A SUBSTANTIAL AMENDMENT TO THE CITY OF PUEBLO'S FY2020 ACTION PLAN TO ADD AN ADDITIONAL PROJECT TO THE FY2020 ANNUAL ACTION PLAN TO ACQUIRE AND REHABILITATE 710 W. 4TH STREET, PUEBLO, CO TO PROVIDE A WARMING SHELTER UTILIZING CASE MANAGEMENT AND NAVIGATION SERVICES FOR THE HOMELESS AND AUTHORIZING THE MAYOR TO EXECUTE AND SUBMIT THE SUBSTANTIAL AMENDMENT TOGETHER WITH ALL REQUIRED AND NECESSARY CERTIFICATIONS, ASSURANCES, AND DOCUMENTATION TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT WHEREAS, the City of Pueblo is an entitlement city under the Housing and Community Development Act of 1974, and received CDBG Grant Funds and CDBG-CV Grant Funds for fiscal year 2020; and WHEREAS, the City of Pueblo conducted a citizen participation process in accordance with the requirements of 24CFR91 that included two public hearings in the City of Pueblo in addition to a third public hearing before City Council to obtain the views of citizens, non-profit, and neighborhood groups on the City’s proposed amended annual action addressing community needs; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Establishing Project No. CDCV-070 – Acquisition of Emergency Shelter. SECTION 2. The funds are available in Fund 250, transferring $50,000.00 from Project No. CDCV- 020 and $350,000.00 from Project No. CDCV-050 into Project No. CDCV-070, and those funds will be dedicated to this Project. SECTION 3. The City Council hereby finds and determines that the Substantial Amendment of the th City of Pueblo’s FY2020 Action Plan to acquire and rehabilitate 710 W. 4 Street, Pueblo, CO for the purposes of providing warming shelter, case management, and navigation services is consistent with the City of Pueblo’s Consolidated Plan and is based on needs identified through public and stakeholder outreach, as required by HUD, and is hereby approved, adopted, and incorporated herein. SECTION 4. The Mayor is hereby authorized to execute and submit, in the name of the City of Pueblo, the applications (SF-424/SF-424D) and the Substantial Amendment to the FY2020 Action Plan, together with all required and necessary certifications, assurances, and documentation to the U.S. Department of Housing and Urban Development. SECTION 5. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 6. If any section, paragraph, clause, or provision of this Ordinance shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause, or provision shall not affect any of the remaining provisions of this Ordinance. SECTION 7. This Ordinance shall become effective on the date of final action by the Mayor and City Council. This substantial amendment to the th FY2020 Action Plan incorporates the acquisition and rehabilitation of 710 W. 4 Street, Pueblo, CO for the purpose of providing a warming shelter, case management, and navigation services for the homeless. This Ordinance adds an additional project to the FY2020 Annual Action Plan and re-distributes ($400,000.00) of CDBG-CV funding to complete the project. The U.S. Department of Housing and Urban Development’s approval of the substantial amendment to the City’s FT2020 Annual Action Plan is required to access the funding. PREVIOUS COUNCIL ACTION: The City Council passed the FY2020 Annual Action Plan under Ordinance No. 9951 on June 14, 2021. BACKGROUND: As an entitlement city, the City of Pueblo is required by the U.S. Department of Housing and Urban Development (HUD) to complete an Annual Action Plan for each of the years of the Consolidated Plan. The City of Pueblo received CDBG-CV funds through the CARES Act. The City is required to complete a Substantial Amendment to the Annual Action Plan when projects are added or deleted or when the funding within the Annual Action Plan is changed by more than ten percent. This Substantial Amendment to the FY2020 Annual Action Plan incorporates the acquisition and rehabilitation of the th facility located at 710 W 4 Street into the FY2020 Annual Action Plan and reallocates $400,000.00 of CDBG-CV Grant funding. The adoption of the substantial amendment to the FY2020 Annual Action Plan and accompanying documentation serves to amend the City’s original application to HUD for the FY2020 Community Development Block Grant (CDBG) and HOME Investment Partnership Act Grant (HOME). A public meeting was held to receive citizen input and to hear applicant presentations on July 19, 2023. Notice of the proposed Substantial Amendment to the Annual Action Plan was published on August 29, 2023, and the text thereof made available to the public for review on August 29, 2023, formally opening the public comment period for thirty-days. Public meetings were held on September 6, 2023, and September 20, 2023. Copies were available at the Department of Housing and Citizen Services, and the City’s website. FINANCIAL IMPLICATIONS: The FY2020 Annual Action Plan shall be amended accordingly: Action/Account Project Description Amount Add Project CDCV-070 Acquisition of Emergency Shelter $400,000 Reduce funding to COVID Testing/Sewer Analysis ($50,000) Project CDCV-020 Reduce funding to Non-Profit Assistance ($350,000) Project CDCV-050 Net Change ($-0-) BOARD/COMMISSION RECOMMENDATION: The Citizen’s Advisory Committee reviewed and ranked the proposed project during receipt of this years annual CDBG grant requests. STAKEHOLDER PROCESS: The following stakeholder processes were undertaken by the Department of Housing and Citizen Services: Community Development grant requests were received during May of 2023 following a notice of funding availability. Applicants presented proposed projects to the CAC on July 19, 2023. The CAC reviewed and ranked the applications received following the presentations. The CAC voted to award funding based on the rank of the application, moving from highest rank to lowest until funds were exhausted on August 9, 2023. ALTERNATIVES: The City Council can choose to not to adopt the Substantial Amendment to the FY2020 Annual Action Plan. RECOMMENDATION: Approval of the Ordinance.
