HomeMy WebLinkAbout10566ORDINANCE NO. 10566 AN ORDINANCE APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE NATIONAL INSURANCE CRIME BUREAU (NICB) AND THE CITY OF PUEBLO RELATING TO AUTHORIZED ACCESS TO NICB RESOURCES TO ASSIST IN THE INVESTIGATION OF THEFT AND FRAUD- RELATED CRIMES, AND AUTHORIZING THE MAYOR TO EXECUTE SAME WHEREAS, the City Council of Pueblo has the authority on behalf of the City of Pueblo, including its Police Department, to approve and enter into agreements and memorandums of understanding; and WHEREAS, approval of the Memorandum of Understanding for the purposes for which it has been made is in the best interest of the City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Memorandum of Understanding between the National Insurance Crime Bureau (“NICB”) and the City of Pueblo, pertaining to access to the resources of NICB in order to investigate and prevent theft and fraud-related crimes, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The President of City Council and the Mayor are authorized to execute the Memorandum of Understanding in the name of the City, and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance and to implement the policies and procedures described therein. SECTION 4. This Ordinance shall become effective upon final action by the Mayor and City Council. Action by City Council: Introduced and initial adoption of Ordinance by City Council on September 25, 2023. Gradisar VIA: Marisa Stoller, City Clerk FROM: Chris Noeller, Chief of Police SUBJECT: AN ORDINANCE APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE NATIONAL INSURANCE CRIME BUREAU (NICB) AND THE CITY OF PUEBLO RELATING TO AUTHORIZED ACCESS TO NICB RESOURCES TO ASSIST IN THE INVESTIGATION OF THEFT AND FRAUD-RELATED CRIMES, AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: Attached is a memorandum of understanding which, upon execution, will allow the Pueblo Police Department to have continued access to resources which the department uses to investigate theft and fraud-related crimes. PREVIOUS COUNCIL ACTION: None. BACKGROUND: NICB maintains a database of information to assist law enforcement in the investigation of theft and fraud-related crimes. This is possible through a collaborative effort between insurance companies, the people they serve, and law enforcement agencies across the country. NICB also provides additional support to law enforcement through training opportunities, documents, and other investigative assistance. These efforts are intended to both solve and prevent crime. The Pueblo Police Department has relied upon NICB’s assistance and expertise in the past with respect to conducting investigations locally. The Pueblo Police Department considers these resources to be extremely important to its mission of solving/preventing crime and would like to continue its relationship with NICB in order to do so. In order to obtain continued access to these resources, NICB is requiring participating agencies to agree to a memorandum of understanding with NICB. FINANCIAL IMPLICATIONS: There are no financial implications with respect to this ordinance. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: Council can choose to decline entering into the agreement and the Pueblo Police Department will lose access to NICB resources. RECOMMENDATION: Approval of the ordinance. ATTACHMENTS: 1.
