HomeMy WebLinkAbout15375RESOLUTION NO. 15375 A RESOLUTION APPOINTING THE CITY CLERK AS THE DESIGNATED ELECTION OFFICIAL FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 7, 2023 AND DIRECTING THE CITY CLERK TO CERTIFY THE CONTENT OF THE BALLOT FOR SAID ELECTION BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. The City Clerk shall be and hereby is appointed as the Designated Election Official for the November 7, 2023 General Municipal Election. SECTION 2. The content of the ballot for the City's General Municipal Election to be held on November 7, 2023 shall be as follows: Question No. 2A – One and One-Half percent Lodger's Tax for Providing Accessible and Affordable Childcare Programs for Working Families in the City SHALL THE CITY OF PUEBLO'S TAXES BE INCREASED BY UP TO $625,000 ANNUALLY (FIRST FULL FISCAL YEAR INCREASE) AND BY WHATEVER AMOUNTS ARE RAISED ANNUALLY THEREAFTER, FOR FIVE YEARS FROM JANUARY 1, 2024 THROUGH DECEMBER 31, 2028, BY ADOPTING ORDINANCE NO. 10500 IMPOSING AN ADDITIONAL ONE AND ONE-HALF PERCENT LODGER’S TAX AND ESTABLISHING A SPECIAL FUND FOR THE DEPOSIT OF SUCH REVENUES TO BE SPENT ONLY FOR PROVIDING ACCESSIBLE AND AFFORDABLE CHILDCARE PROGRAMS FOR WORKING FAMILIES IN THE CITY AND, CONSISTENT WITH ORDINANCE NO. 9998 APPROVED AT THE 2021 MUNICIPAL GENERAL ELECTION OR AS OTHERWISE MAY BE REQUIRED, SHALL ALL REVENUES DERIVED FROM SUCH TAX BE COLLECTED, RETAINED AND SPENT, NOTWITHSTANDING ANY LIMITATIONS PROVIDED BY LAW, AS A VOTER APPROVED REVENUE CHANGE AND AN EXCEPTION TO THE LIMITS WHICH WOULD OTHERWISE APPLY PURSUANT TO ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION OR ANY OTHER LAW? The City Clerk shall be and hereby is directed to certify the content of the ballot for the November 7, 2023 General Municipal Election in accordance with applicable law. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with this Resolution to implement the policies and procedures described herein. SECTION 5. This Resolution shall take effect immediately upon final passage and approval. Gradisar VIA: Marisa Stoller, City Clerk FROM: Marisa Stoller, City Clerk SUBJECT: A RESOLUTION APPOINTING THE CITY CLERK AS THE DESIGNATED ELECTION OFFICIAL FOR THE GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 7, 2023 AND DIRECTING THE CITY CLERK TO CERTIFY THE CONTENT OF THE BALLOT FOR SAID ELECTION SUMMARY: This Resolution appoints the City Clerk as the Designated Election Official for the November 7, 2023 General Municipal Election. This Resolution also directs the City Clerk to certify the content of the ballot for said election. PREVIOUS COUNCIL ACTION: On June 26, 2023, by Ordinance No. 10496, City Council directed that the November 7, 2023 General Municipal Election be conducted as part of a Coordinated Election with Pueblo County. BACKGROUND: C.R.S. 1-5-203 (3)(a) requires that the Designated Election Official of each political subdivision participating in a Coordinated Election to certify the order of the ballot and ballot content. Such certification is to be delivered to the County Clerk and Recorder no later than sixty (60) days before the Coordinated Election. FINANCIAL IMPLICATIONS: The City shall pay to the County Clerk the City's share of the actual cost of materials and services directly attributable to the City’s participation in the Coordinated Election. Funding for the costs associated with conducting this Special Municipal Election is allocated in the City Clerk’s 2023 Departmental Budget. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: If this Resolution is not adopted, the City will be unable to proceed with the November 7, 2023 General Municipal Election. RECOMMENDATION: Approval of the Resolution. ATTACHMENTS: None
