HomeMy WebLinkAbout10562ORDINANCE NO. 10562 AN ORDINANCE AMENDING ZONING RESTRICTIONS FROM I- 2, INDUSTRIAL ZONE DISTRICT AND I-3 HEAVY INDUSTRIAL ZONE DISTICT TO S-1, GOVERNMENT USE ZONE DISTRICT FOR APPROXIMATELY 2.9-ACRES GENERALLY LOCATED WEST OF SANTA FE DRIVE, NORTH AND EAST OF RICHMOND AVENUE, AND SOUTH OF MECHANIC STREET BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property, and in addition half of all adjacent dedicated roadway and alley rights-of-way, together generally identified in the attached Rezone Exhibit, is hereby changed from I-2, Industrial Zone District and I-3, Heavy Industrial Zone District to S-1, Government Use Zone District: A PORTION OF THE WEST HALF OF THE SOUTHEAST QUARTER SECTION 19, TOWNSHIP 20 SOUTH, RANGE 64 WEST OF THE SIXTH PRINCIPAL MERIDIAN, COUNTY OF PUEBLO, STATE OF COLORADO, BEING DESCRIBED AS FOLLOWS: BASIS OF BEARINGS: THE CENTER LINE OF RICHMOND AVENUE BEING MONUMENTED AT THE SOUTHEASTERLY END SOUTHEASTERLY END BY A BRASS TACK AND THE NORTHWESTERLY END BEING THE INTERSECTION OF RICHMOND AVENUE AND CENTRAL MAIN STREET BY A ALUMINUM CAP AND THE ASSUMED TO BEAR N46°04'51”W A DISTANCE OF 750.40 FEET. Gradisar VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS FROM I-2, INDUSTRIAL ZONE DISTRICT AND I-3 HEAVY INDUSTRIAL ZONE DISTICT TO S-1, GOVERNMENT USE ZONE DISTRICT FOR APPROXIMATELY 2.9-ACRES GENERALLY LOCATED WEST OF SANTA FE DRIVE, NORTH AND EAST OF RICHMOND AVENUE, AND SOUTH OF MECHANIC STREET SUMMARY: The City of Pueblo is requesting to rezone approximately 2.9-acres from I-2, Industrial Zone District and I-3, Heavy Industrial Zone District to S-1, Government Use Zone District to facilitate an expansion of the Historic Arkansas Riverwalk of Pueblo (HARP) Development. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The City of Pueblo recently acquired the 2.9-acre site, which consists of three parcels, and is intended to be redeveloped as the Historic Arkansas Riverwalk of Pueblo (HARP) Channel Extension and Boathouse, Phase IV Project. The proposed boathouse construction and HARP river channel expansion, east to Santa Fe Avenue, is included in the HARP Future Development Plan, prepared by Design Studios West in July 2010. The northeastern and northwestern parcels (175 South Santa Fe Avenue and 131 North Mechanic Street) of the rezoning site are currently developed and operating as Ferguson Plumbing Supply. The northwestern parcel is currently zoned I-2, the northeastern parcel is zoned both I-2 and I-3. The City purchased the two parcels in March 2023 and currently leases the land to Ferguson Plumbing Supply. The lease to Ferguson Supply expires in March 2025; however, it is expected that Ferguson will vacate the premises prior to the expiration of the lease as they are currently developing a new site at 1105 South Santa Fe Avenue. The third parcel located at the southern end of the rezoning site (209 South Santa Fe Avenue) is undeveloped and zoned both I-2 and I-3. Pueblo Urban Renewal Authority (PURA) acquired this parcel in 2000 and granted the parcel to the City in 2001 specifically for the planned river channel expansion east to Santa Fe Avenue. Once Ferguson has ceased operation at the current location, the City will request to vacate portions Richmond Avenue, a 20-foot alley, and a portion of Mechanic Street to facilitate a Subdivision that will create lots for the river channel extension and a lot for future development. According to the preliminary site plan, the proposed HARP Channel Expansion project will extend the river channel approximately 320 feet to the north and east from its current terminus at Richmond Avenue. A bulb will be constructed at the end of the channel, adjacent to Santa Fe Avenue. A 10-foot sidewalk will be constructed adjacent to the channel extension and site improvements will include landscaping, greenspace, and paved parking. Currently all portions of the developed HARP river channel and associated public amenities are zoned S-1; therefore, the proposed S-1 rezoning is consistent with existing HARP development. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their July 12, 2023 Regular Meeting, voted 6- 0 to recommend approval, Commissioner Martinez absent. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property will not be zoned in accordance with the Pueblo Municipal Code. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
