AN ORDINANCE AMENDING ZONING RESTRICTIONS TO
REZONE APPROXIMATELY 3,000 SQUARE FEET OF LAND AT
718 WEST 4TH STREET FROM B-4, REGIONAL BUSINESS
ZONE DISTRICT TO S-1, GOVERNMENT USE ZONE DISTRICT
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The zoning restrictions covering the following described property, and in addition half of
all adjacent dedicated roadway and alley rights-of-way, together generally identified in the
attached Rezone Exhibit, is hereby changed from B-4, Regional Business Zone District to S-1,
Government Use Zone District:
Lot 25, Block 3, Thatcher and Gast’s Subdivision
SECTION 2.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of the Ordinance to implement the policies and procedures described herein.
SECTION 3.
This Ordinance shall become effective immediately upon final action by the Mayor
and City Council.

The applicant is requesting to rezone approximately 3,000 square feet at 718 West 4
Street from B-4, Regional Business Zone District to S-1, Government Use Zone District
to facilitate support uses for the adjacent Pueblo Rescue Mission Shelter.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
This rezone site is a 3,000 square foot parcel that was recently purchased by the City.
The purpose of this rezone is to allow the City to utilize the land for support services in
tandem with the adjacent Pueblo Rescue Mission shelter. Currently, the site is zoned
as a B-4 Regional Business District, which limits the potential supporting land use for
the homeless shelter, located west of the site. Should the parcel be rezoned as an S-1,
the city has more flexibility to utilize the property for governmental uses allowed for
within an S-1 Governmental Use Zone District. Any plans for the development of the
property must be reviewed and approved by the City Planning & Zoning Commission
prior to the approval of building permits or other site improvements. There are currently
no detailed site plans for the parcel, as the funding for this project is not yet finalized
and will affect exactly what improvement will be proposed for the property. The existing
structure on this property is not currently in use and the Regional Building Department
provided some background on its recent history (see attachment F). The intention is to
have the structure demolished and have the property prepared for a future use. The S-
1, Government Use District is intended to retain and provide land areas held, used, or
controlled for governmental purposes by or for any department or branch of
government. The S-1 District will allow flexibility regarding development and use of the
site. Generally, land owned and actively used by local, state, or federal governments,
such as public schools or special districts, is zoned S-1.
FINANCIAL IMPLICATIONS:
There are no financial implications for the City.
BOARD/COMMISSION RECOMMENDATION:
The Planning and Zoning Commission, at their August 9, 2023 Regular Meeting, voted
5-0 to recommend approval, Commissioners Aznar and Pasternak absent.
STAKEHOLDER PROCESS:
The Planning Department sent out Notice of the Planning and Zoning Commission
Public Hearing to all property owners located within 300 feet of the subject property.
A Public Notice poster was placed on the subject property 15 days prior to the Public
Hearing.
ALTERNATIVES:
If City Council does not approve this Ordinance the property will not be zoned in
accordance with the Pueblo Municipal Code.
Upon request of City Council, the Ordinance could be returned to the Planning and
Zoning Commission for consideration of proposed modifications.
RECOMMENDATION:
Approval of the Ordinance.
