HomeMy WebLinkAbout10546ORDINANCE NO.10546 AN ORDINANCE DESIGNATING 314 WEST 18TH STREET, THE EDWARD TELLER HOUSE, AS A LOCAL HISTORIC LANDMARK WHEREAS, the City of Pueblo’s Historic Preservation Code, Chapter 14, Title IV, states that the City shall identify, designate and preserve those buildings, objects, monuments, structures and sites which reflect outstanding elements of the community’s architectural and cultural heritage; and, WHEREAS, the present application was initiated by the property owner, and the City’s Historic Preservation Commission has reviewed the application for designation of 314 West 18th Street,the Edward Teller House, as a Local Historic Landmark and has recommended to the Planning and Zoning Commission the designation of this resource; and, WHEREAS, the City Planning and Zoning Commission has reviewed the Historic Preservation Commission’s recommendation and the designation application and submitted its recommendation thereon for landmark designation to Council; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. th The City Council finds and determines that 314 West 18 Street, Pueblo, Colorado, the Edward Teller House, and legally described as Lot 7 and 8, Block 24, Henry C. Brown’s Addition, AKA Henry C. Brown’s Addition, is associated with history, architecture, and geography. It qualifies under landmark Criteria 1A, significant events/people, and qualifies under landmark Criteria 2A, architecture, and complies with the criteria as defined in the Pueblo Historic Preservation Code Section 4-14-8. SECTION 2. th The City Council hereby designates 314 West 18 Street, the Edward Teller House, as a local Pueblo Historic Landmark, subject to the benefits, obligations and restrictions resulting from such designation as described in Chapter 14, Title IV of the Pueblo Municipal Code. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE DESIGNATING 314 WEST 18TH STREET, THE EDWARD TELLER HOUSE, AS A LOCAL HISTORIC LANDMARK SUMMARY: th The applicant is requesting to designate 314 West 18 Street, the Edward Teller House, as a local landmark. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The property owner is requesting to designate 314 West 18th Street, the Edward Teller House, as a local Landmark. The applicant provided documentation to demonstrate that the residence was constructed in 1918 and associated with Edward Teller, quarry owner; Dr. James H. Risley, Pueblo, Superintendent of Pueblo City Schools, and Matt Peulen, two-time County Commissioner. The applicant is seeking designation to honor its past as well as to utilize the state tax credit for rehabilitation. The home was also considered for inclusion into the North Side Historic District in 2007; however, the property owner, at that time, requested the property be removed from the district. The residence qualifies under landmark Criteria 1A, significant events/people, for having direct association with Edward Teller, Matt Peulen, and especially Dr. Risely who was the first superintendent of District 60 and published books on education theory nationally. The building also qualifies for nomination under criteria 2A, architecture, as a good example of a Craftsman style home. The subject property is in the 2022, Pueblo Comprehensive Plan Urban Neighborhoods Future Land Use area, and the landmarking is compatible with the goals of the plan, which highlights the importance of expanding local Landmarks. A detailed review of the Comp Plan compliance is discussed in the staff report, for case number HPC-23-05. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Historic Preservation Commission, at their June 21, 2023 Regular Meeting, voted 5-0 to recommend approval. Commissioners Perko and Scoby absent. The Planning and Zoning Commission, at their July 12, 2023, Regular Meeting, voted 6-0 to recommend approval. Commissioner Martinez absent. STAKEHOLDER PROCESS: The application was reviewed at a public hearing held by the Pueblo Historic Preservation Commission held on June 21, 2023 and the application was also reviewed by the City of Pueblo Planning and Zoning Commission at their July 12, 2023 meeting. ALTERNATIVES: th If City Council does not approve this Ordinance, 314 West 18 Street, will not be designated as a Local Historic Landmark. Upon request of City Council, the Ordinance could be returned to the Historic Preservation Commission and the Planning and Zoning Commission for consideration of proposed modifications.
