HomeMy WebLinkAbout10543ORDINANCE NO. 10543 AN ORDINANCE APPROVING AND ACCEPTING A COOPERATIVE AGREEMENT BETWEEN THE CITY OF PUEBLO ON BEHALF OF THE PUEBLO POLICE DEPARTMENT, THE PUEBLO COUNTY DEPARTMENT OF HUMAN SERVICES, THE PUEBLO COUNTY SHERIFF'S OFFICE, AND THE 10TH JUDICIAL DISTRICT ATTORNEY'S OFFICE WITH RESPECT TO THE INVESTIGATION OF CHILD ABUSE AND NEGLECT CASES, AND AUTHORIZING THE MAYOR TO EXECUTE SAME BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Cooperative Agreement between the City on behalf of the Pueblo Police Department, the Pueblo County Department of Human Services, the Pueblo County Sheriff’s Office, and the 10th Judicial District Attorney’s Office, having been approved by the City Attorney, is hereby approved. SECTION 2. The Mayor is hereby authorized to execute the Cooperative Agreement on behalf of the City of Pueblo, and the City Clerk shall affix the Seal of the City thereto and attest same. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance and to implement the policies and procedures described therein. SECTION 4. This Ordinance shall become effective upon final action by the Mayor and City Council. Action by City Council: Introduced and initial adoption of Ordinance by City Council on August 14, 2023. Gradisar VIA: Marisa Stoller, City Clerk FROM: Chris Noeller, Chief of Police SUBJECT: AN ORDINANCE APPROVING AND ACCEPTING A COOPERATIVE AGREEMENT BETWEEN THE CITY OF PUEBLO ON BEHALF OF THE PUEBLO POLICE DEPARTMENT, THE PUEBLO COUNTY DEPARTMENT OF HUMAN SERVICES, THE PUEBLO COUNTY SHERIFF'S OFFICE, AND THE 10TH JUDICIAL DISTRICT ATTORNEY'S OFFICE WITH RESPECT TO THE INVESTIGATION OF CHILD ABUSE AND NEGLECT CASES, AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: The cooperative agreement under consideration sets out the responsibilities of the respective agencies agreeing thereto when it becomes necessary for inter-agency cooperation during child abuse and neglect investigations. PREVIOUS COUNCIL ACTION: None. BACKGROUND: Investigations with respect to child abuse and neglect often involve complex investigations that necessitate a cooperative response by law enforcement and child protection authorities. That being the case, the goal of the cooperative agreement is to foster cooperative joint-decision making while also improving the lines of communication between the participating agencies. This agreement will also provide guidance as to the responsibilities of each agency when joint investigations occur. FINANCIAL IMPLICATIONS: This Ordinance does not create any additional financial obligations. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: Council can choose to reject the agreement as written, leaving no cooperative agreement in place. RECOMMENDATION: Passage of the Ordinance. ATTACHMENTS: 1.
