AN ORDINANCE AMENDING THE FY 2023 STAFFING
ORDINANCE BY CONVERTING A VACANT CIVIL ENGINEER-
CONSTRUCTION POSITION WITHIN THE PUBLIC WORKS
DEPARTMENT TO A NEW CLASSIFICATION OF
CONSTRUCTION MANAGER
WHEREAS, it is necessary to create a new classification of Construction Manager for
ultimate efficiency and functionality for the Public Works Department; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The following section captioned “Public Works Engineering” of Ordinance No. 10363,
being the 2023 Staffing Ordinance, is amended as follows:
The following positions shall be authorized for FY 2023:
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and all
acts consistent with the intent of this Ordinance to implement any transactions described
therein.
SECTION 3.
This Ordinance shall be deemed to amend the Fiscal Year 2023 Budget and staffing
with respect to the allocation of positions within the Public Works Department and shall become
effective on the date of final action by the Mayor and City Council.

Final adoption of Ordinance by City Council on August 28, 2023.

SUBJECT: AN ORDINANCE AMENDING THE FY 2023 STAFFING ORDINANCE
BY CONVERTING A VACANT CIVIL ENGINEER-CONSTRUCTION
POSITION WITHIN THE PUBLIC WORKS DEPARTMENT TO A NEW
CLASSIFICATION OF CONSTRUCTION MANAGER
SUMMARY:
The Public Works Department, with Mayor Gradisar’ s approval, requests to convert a
currently vacant position in the Public Works Department from the classification of Civil
Engineer-Construction to a new classification of Construction Manager to improve
operational efficiencies within the department.
PREVIOUS COUNCIL ACTION:
On December 27, 2022, City Council approved Ordinance No. 10363. This Ordinance
provided authorized staffing for Fiscal Year 2023.
BACKGROUND:
The Public Works Department requests to convert a currently vacant position of Civil
Engineer/ Construction to a new classification of Construction Manager.
The Public Works Department requires the services of a professional construction
manager to lead the construction management team within the Engineering Division.
That team includes the City's Associate Field Engineers and Construction Inspectors
who are responsible for day-to-day oversight of City construction projects and
inspection/acceptance of public improvements constructed by private developers and
builders.
The proposed Construction Manager position is being converted from the existing Civil
Engineer/Construction position which currently requires the incumbent to be a licensed
professional engineer (PE). The Engineering Division already has three other positions
that require the incumbent to be licensed - the Engineering Manager, the Deputy
Director, and the Director of Public Works. The Civil Engineer/Construction
classification will be abolished as a part of this conversion.
If the conversion is approved, the Construction Manager would report directly to the
Engineering Manager. Based on the fact that the proposed Construction Manager
position will be working under the direct supervision of a licensed professional engineer,
there is no need to require that the Construction Manager possess this same PE
credential.
By modifying the education/experience/credential requirements for the position through
this conversion, the pay range for the position can be adjusted and the City will realize
salary savings. In addition, adjusting the minimum qualifications will create new
pathways and opportunities for promotion within the Department that would have
otherwise been restricted only to licensed professional engineers.
FINANCIAL IMPLICATIONS:
This is a zero net change to staffing levels within the Public Works Department and
there is no cost associated with this classification change. The City’s General Fund will
realize a cost savings of approximately $32,000 annually if this vacancy conversion is
approved.

ALTERNATIVES:
The no action alternative would be to retain the current staffing level which would
eliminate any opportunity to re-balance staff workload and enhance department
efficiencies.

Approval of this Ordinance.
