HomeMy WebLinkAbout10528 ORDINANCE NO. 10528 AN EMERGENCY ORDINANCE TRANSFERRING $100,000 FROM THE UNAPPROPRIATED FUND BALANCE OF THE GENERAL FUND TO CI2205, BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $100,000 AND AUTHORIZING THE MAYOR TO EXECUTE SAME WHEREAS, the Emergency Ordinance is necessary to transfer funds to complete geothermal thermal connectivity testing; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. Funds in the amount of $100,000.00 are hereby transferred from the unappropriated fund balance of the general fund into account Project CI2205, Fire 3 Stations - Arch/Design Project, and budgeted and appropriated account Project CI2205. SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with this Emergency Ordinance to implement the policies and procedures described herein. SECTION 3. Savings Clause. The immediate transfer of funds authorized by this Ordinance is necessary to complete the thermal connectivity test for geothermal while a geothermal bore testing company is available. Given these time restraints, the enactment of this Ordinance is necessary for the immediate preservation or protection of public health, property or safety. Pursuant to Sec. 3-20 of the City Charter, this Ordinance shall become effective upon final action by the Mayor and City Council Action by City Council: Introduced and initial adoption of Ordinance by City Council on July 24, 2023. Gradisar VIA: Marisa Stoller, City Clerk FROM: Andrew Hayes, Public Works Director SUBJECT: AN EMERGENCY ORDINANCE TRANSFERRING $100,000 FROM THE UNAPPROPRIATED FUND BALANCE OF THE GENERAL FUND TO CI2205, BUDGETING AND APPROPRIATING FUNDS IN THE AMOUNT OF $100,000 AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: This Emergency Ordinance transfers funds in the amount of $100,000.00 from the unappropriated fund balance of the general fund to CI2205 - Fire 3 Stations - Arch/Design Project, and budgets and appropriates funds totaling $100,000.00 for the Project. PREVIOUS COUNCIL ACTION: Ordinance 10110, dated February 14, 2022, established Fire Station 6, 8, and 11 Project, account Project No. CI2205, transferred $600,000.00 from the unappropriated fund balance of the general fund, and budgeted and appropriated $600,000.00. Ordinance 10188, dated June 13, 2022, transferred $609,245.00 from the unappropriated fund balance of the general fund, and budgeted and appropriated $609,245.00. Ordinance, 10202, dated June 27, 2022, transferred $270,000.00 from the "2022" unappropriated fund balance of the general fund, and budgeted and appropriated $270,000.00. Resolution 14938, dated July 11, 2022, awarded an agreement for Professional Design Services to Allred and Associates for design and engineering services of new Fire Stations 6, 8, and 11. Resolution 14921, dated June 27, 2022, awarded an agreement for Professional Services to Dunakilly Management Group Corp. for project representation, design review support, and construction inspection services for new Fire Stations 6, 8, and 11. BACKGROUND: This project is part of infrastructure and response improvements for the City of Pueblo and its Fire Departments, relocating Fire Stations 1, 6, and 8, and building a new Fire Station 11. As part of the City of Pueblo's energy reduction goals, the new Fire Station buildings will be built to use as little energy as possible. In an effort to achieve Net Zero buildings, the Fire Stations are being designed to utilize alternative energy, reduce energy consumption and offset energy consumption with renewable energy. Allred and Associates, were contracted by the City of Pueblo to provide design services for Fire Stations 6, 8, and 11. Through their design work, Allred and Associates has identified several upgrades for Net Zero, including Geothermal, Photovoltaic (solar panels), and energy reduction at the proposed Fire Stations 6, 8 and 11, as well as the future Fire Station 1. In order to design and engineer the Geothermal system for these four (4) fire stations, holes must be bored approximately 450 feet deep to test for thermal conductivity. The Ordinance is determined to be an emergency due to the lack of geothermal bore testing companies in Colorado, and that a company out of Montana is available to do the testing immediately because they are in Brighton, Colorado for another project. The City of Pueblo has a contract with Allred and Associates, who will contract with the bore company; however, the cost associated with the testing is the responsibility of the City, through a future contract amendment with Allred and Associates. This Emergency Ordinance transfers $100,000.00 in advance of the contract amendment. FINANCIAL IMPLICATIONS: The funds in the amount of $100,000.00 are being transferred from the unappropriated fund balance of the general fund to CI2205. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: The alternative would be to remove geothermal renewable energy and seek alternative sources to reduce energy usage. RECOMMENDATION: Approve the Emergency Ordinance. ATTACHMENTS: None
