HomeMy WebLinkAbout10522*ORDINANCE NO. 10522 AN ORDINANCE APPROVING AN AGREEMENT TO BUY AND SELL REAL ESTATE BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND PUEBLO URBAN RENEWAL AUTHORITY, A PUBLIC BODY CORPORATE AND POLITIC OF THE STATE OF COLORADO, RELATING TO THE SALE OF PROPERTY AT 612 E. 2ND STREET, PUEBLO, COLORADO AND 618 E. 2ND STREET, PUEBLO, COLORADO FOR THE AMOUNT OF TEN THOUSAND, EIGHT HUNDRED, FORTY-SIX DOLLARS AND TWENTY-FIVE CENTS ($10,846.25), AND AUTHORIZING THE MAYOR TO EXECUTE SAME BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Agreement to Buy and Sell Real Estate (“Agreement”) dated July 10, 2023, between the City of Pueblo, a Municipal Corporation, and Pueblo Urban Renewal Authority, a Public Body Corporate and Politic of the State of Colorado, a copy of which is attached hereto and is incorporated herein by this reference, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is authorized to execute and deliver the Agreement in the name of the City and the City Clerk is authorized to fix the seal of the City thereto and attest same. The Mayor is further authorized to execute and deliver the accompanying Special Warranty Deeds and related documents at closing, transferring the property owned by the City to Pueblo Urban Renewal Authority in the manner described in the Agreement. SECTION 3. Proceeds from the sale in the amount of $10,846.25 are to be repaid to the U.S. Department of Housing and Urban Development. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance and the attached Agreement appropriate to implement the transactions described therein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Bryan Gallagher, Director of Housing and Citizen Services SUBJECT: AN ORDINANCE APPROVING AN AGREEMENT TO BUY AND SELL REAL ESTATE BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND PUEBLO URBAN RENEWAL AUTHORITY, A PUBLIC BODY CORPORATE AND POLITIC OF THE STATE OF COLORADO, RELATING TO THE SALE OF PROPERTY AT 612 E. 2ND STREET, PUEBLO, COLORADO AND 618 E. 2ND STREET, PUEBLO, COLORADO FOR THE AMOUNT OF TEN THOUSAND, EIGHT HUNDRED, FORTY-SIX DOLLARS AND TWENTY-FIVE CENTS ($10,846.25), AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: Attached is an Ordinance approving, and authorizing the Mayor to sign, an agreement for the City to sell two parcels of unimproved land located at 618 & 612 E. 2nd Street in the Mattices Subdivision (Parcel 1 and Parcel 2) to Pueblo Urban Renewal Authority for Two Thousand, Seven Hundred, Twelve Dollars and Eighty-Nine Cents ($2,712.89) and Eight Thousand, One Hundred, Thirty-Three Dollars and Thirty-Six Cents ($8,133.36), respectively, for a total of Ten Thousand, Eight Hundred, Forty-Six Dollars and Twenty-Five Cents ($10,846.25). PREVIOUS COUNCIL ACTION: Not applicable to this Ordinance. BACKGROUND: nd The property at 618 E 2 Street was acquired by the City through the redemption of a nd tax lien and the adjacent property at 612 E. 2 Street was purchased from the owner, both in 2012. The Properties are more specifically designated as: Parcel: 431232004 Legal Description: Lot Six and Seven (6 and 7), Block Twenty (20), Mattices Subdivision Commonly known as: 618 E. 2nd Street, Pueblo, Colorado 81001 (hereinafter referred to as “Parcel 1”) AND Parcel: 431232005 Legal Description: Lot Eight and Nine (8 and 9), Block Twenty (20), Mattice’s Subdivision Commonly known as: 612 E. 2nd Street, Pueblo, Colorado 81001 (hereinafter referred to as “Parcel 2”) FINANCIAL IMPLICATIONS: The City will receive $10,846.25 from the sale. Closing costs and fees will be paid by the Pueblo Urban Renewal Authority. The Pueblo Urban Renewal Authority will pay for title insurance. Proceeds of the sale will reimburse the U.S. Department of Housing and Urban Development for costs associated with acquisition and holding. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: City Council may decide not to sell the Property.
