HomeMy WebLinkAbout15338RESOLUTION NO. 15338 A RESOLUTION APPROVING COMPENSATION WITH RESPECT TO A LEGAL SERVICES AGREEMENT WITH HOFFMANN, PARKER, WILSON & CARBERRY, P.C. BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. Compensation set forth in the Legal Services Agreement with Hoffmann, Parker, Wilson & Carberry, P.C., a copy of which is attached hereto, is hereby approved. SECTION 2. Compensation shall be paid from the professional services account of the law department or, if necessary, by transfer of any unencumbered appropriation balance or portion thereof from one classification of expenditure to another within the law department. SECTION 3. The officers of the City are authorized to perform any and all acts consistent with the intent of this Resolution to implement the policies and procedures described herein. SECTION 4. This Resolution shall become effective immediately upon final passage. SUMMARY: This Resolution approves compensation set forth in the Legal Services Agreement with Hoffmann, Parker, Wilson & Carberry, P.C., a copy of which is attached hereto. PREVIOUS COUNCIL ACTION: Ordinance 10503 (July 10, 2023) budgeted and appropriated an amount of $120,000 from the unappropriated fund balance of the General Fund to the Professional Services Account of the Law Department for special counsel on an as needed basis. BACKGROUND: Pursuant to Section 6-7 of the City Charter, special council is retained solely by the City Attorney but compensation is approved by City Council. Given current staffing and the transitional phase of the law department, special counsel on an as needed basis including as relates to the 2023 election and runoff and ARPA funding issues is required. The law firm of Hoffmann, Parker, Wilson & Carberry, P.C., is one of the largest and most reputable law firms representing municipalities in Colorado. FINANCIAL IMPLICATIONS: This firm's hourly rate for this engagement is $300 per hour, and to the extent paralegal assistance is necessary, a rate of $115 per hour for paralegal work. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: Not approve Resolution.
