A RESOLUTION RATIFYING AN EMERGENCY
CONSTRUCTION CONTRACT IN THE AMOUNT OF $4,563.43
WITH PARKER EXCAVATING, INC. FOR EMERGENCY
SANITARY SEWER POINT REPAIR AT 1402 E. 9TH STREET,
PROJECT NO. 20-059 (WWAN03) AND APPROVING THE
PURCHASING AGENT’S EXECUTION OF THE SAME
WHEREAS, an emergency sanitary sewer repair was authorized by the Mayor in
accordance with Section 1-10-5 of the Pueblo Municipal Code; and
WHEREAS, the point repair work was awarded to Parker Excavating, Inc., under the
2021-2023 multi-year point repair contract; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
City Council ratifies and approves the contract for repair of the sanitary sewers at 1402
E. 9th St with Parker Excavating, Inc., Project No. 20-059 (WWAN03) awarded to said bidder in
the amount of $4,563.43.
SECTION 2.
Funds for Project 20-059 (WWAN03) shall be from the Sewer User Fund.
SECTION 3.
The Purchasing Agent was authorized to execute said contract on behalf of Pueblo, A
Colordo Municipal Corporation, and the City Clerk properly affixed the seal of the City thereto
and attested the same.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Resolution and the contract to implement the transactions described
therein. Furthermore, all actions previously taken by officers and staff of the City consistent with
the contract including any payments authorized under the contract are hereby ratified.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.

SUMMARY:
This Resolution ratifies and approves award of a construction contract to Parker
Excavating, Inc. for emergency sanitary sewer point repairs at 1402 E. 9th St.
PREVIOUS COUNCIL ACTION:
None
BACKGROUND:
On May 10, 2023, the Wastewater Department was notified of a sink hole in the alley
behind 1402 E. 9th St. A television crew was sent out to inspect the main and they
discovered mud was oozing into the sewer main from a hole in the pipe at the same
location as the sinkhole, which was likely due to heavy rains. An emergency repair was
necessary to fix the sinkhole and repair the pipe segment, so the mud entering the main
would be stopped and a backup would not occur.
The repair work was performed under the Sanitary Sewer Point Repair multi-year
contract under which three contractors were qualified via competitive bid. An estimate
was prepared, and Parker Excavating was the lowest bidder and accepted the work.
The cost breakdown for the project is as follows:

Surface Improvement Related
Total: $ 1,330.00 29%
Grand Total: $ 4,563.43 100%
FINANCIAL IMPLICATIONS:
Funding for this project came from the sanitary sewer rehabilitation budget funded by
the Sewer User Fund. Funding was available and had been budgeted, appropriated,
and allocated to Project No. 20-059 (WWAN03).

Not applicable

ALTERNATIVES:
Not approve the Resolution, but this would require a finding that there was not an
emergency condition.
RECOMMENDATION:
Approval of the Resolution.
