A RESOLUTION RATIFYING AN EMERGENCY
CONSTRUCTION CONTRACT IN THE AMOUNT OF
$149,743.81 WITH PARKER EXCAVATING, INC. FOR
EMERGENCY SANITARY SEWER POINT REPAIR AT 2820
ASTER ST, PROJECT NO. 20-059 (WWAN03) AND
APPROVING THE PURCHASING AGENT’S EXECUTION OF
THE SAME
WHEREAS, an emergency sanitary sewer repair was authorized by the Mayor in
accordance with Section 1-10-5 of the Pueblo Municipal Code; and
WHEREAS, the point repair work was awarded to Parker Excavating, Inc., under the
2021-2023 multi-year point repair contract; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
City Council ratifies and approves the contract for repair of the sanitary sewers at 2820
Aster St with Parker Excavating, Inc., Project No. 20-059 (WWAN03) awarded to said bidder in
the amount of $149,743.81.
SECTION 2.
Funds for Project 20-059 (WWAN03) shall be from the Sewer User Fund.
SECTION 3.
The Purchasing Agent was authorized to execute said contract on behalf of Pueblo, A
Municipal Corporation, and the City Clerk properly affixed the seal of the City thereto and
attested the same.
SECTION 4.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Resolution and the contract to implement the transactions described
therein. Furthermore, all actions previously taken by officers and staff of the City consistent with
the contract including any payments authorized under the contract and the contract change
order in the amount of $13,145.81 are hereby ratified.
SECTION 5.
This Resolution shall become effective immediately upon passage and approval.

SUMMARY:
This Resolution ratifies and approves award of a construction contract to Parker
Excavating, Inc. for emergency sanitary sewer point repairs at 2820 Aster St.
PREVIOUS COUNCIL ACTION:
None
BACKGROUND:
On January 18th, 2023, the Wastewater Department was notified of a large sink hole in
the 2800 block of Aster Street. The collection crew televised the main and discovered a
large sag in the main. The crew could not televise the downstream pipe segment due to
the sag and safety concerns as the downstream manhole is in Pueblo Boulevard. After
the sag and the sinkhole were repaired, the television crew were able to televise the
remaining pipe and discovered more large sags in the downstream pipe segment
extending into Pueblo Boulevard. An emergency repair was necessary to repair the
sinkhole and the sags, and to prevent a backup due to the existing sags.
The repair work was performed under the Sanitary Sewer Point Repair multi-year
contract under which three contractors were qualified via competitive bid. An estimate
was prepared, and K.R. Swerdfeger Construction, Inc. was the low bidder but could not
perform the work. The project was awarded to the next low bidder, Parker Excavating.
The cost breakdown for the project is as follows:

Surface Improvement Related
Total: $ 31,795.40 21 %
Grand Total: $ 149,743.81 100%
FINANCIAL IMPLICATIONS:
Funding for this project came from the sanitary sewer rehabilitation budget funded by
the Sewer User Fund. Funding was available and had been budgeted, appropriated,
and allocated to Project No. 20-059 (WWAN03).

Not applicable

None
ALTERNATIVES:
Not approve the Resolution, but this would require a finding that there was not an
emergency condition.
RECOMMENDATION:
Approval of the Resolution.
