The zoning restrictions covering the following described property, and in addition half of all adjacent dedicated roadway and alley rights-of-way, together generally identified in the attached Rezone Exhibit, is hereby changed from Pueblo Icehouse, Planned Unit Development to Watertower Place, Planned Unit Development: Parcel A and Parcel B, Pueblo Ice House Subdivision SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE PUEBLO ICEHOUSE, PLANNED UNIT DEVELOPMENT TO WATERTOWER PLACE, PLANNED UNIT DEVELOPMENT SUMMARY: The applicant is requesting to rezone the existing Pueblo Icehouse, Planned Unit Development (PUD) to the Watertower Place, Planned Unit Development. PREVIOUS COUNCIL ACTION: The applicant is requesting to rezone the existing Pueblo Icehouse, Planned Unit Development (PUD) to the Watertower Place, Planned Unit Development. BACKGROUND: The applicant is requesting approval of the Watertower Place, Planned Unit Development Guide relating to the property located north of Spring Street and west of Santa Fe Avenue. The proposed PUD is a reimagining of the previous Icehouse PUD by a new owner, whereas the site has been simplified into two zone districts with a focus on commercial and industrial uses. Provisions have been made to allow for various residential uses, however they all require a Special Use Permit to make sure there are no major conflicts with the existing adjacent uses. The PUD Development Guide provides as much flexibility as possible into the site’s table of uses and anticipates future development to be driven by opportunity and market forces. The current Icehouse PUD, Map Amendment No. Z-07-04, was reviewed by the Planning and Zoning Commission on March 14, 2007 and the Commission recommended that City Council rezone the property from I-3, Heavy Industrial Zone District, to PUD Zone District, to create a mixed-use project in downtown Pueblo next to the Historic Arkansas Riverwalk Project. The City Council held a public hearing for Map Amendment No. Z- 07-04 and render a decision to approve the rezoning on April 23, 2007. The Pueblo Icehouse PUD consisted of one (1) four to five-story brick warehouse, two (2) smaller, one-story out buildings, and two (2) prominent water towers. Most of the building was built in 1915 with beautiful brick and stone details and will be restored to the beautiful architecture of its former splendor by preserving historic elements and removing non- historic elements that were added on over the years. The traditional model for vertically mixed-use projects is to occupy the first/ground floor with retail shops and offices and the upper floors for residential lofts and apartments. On April 3, 2015, the property was purchased by 303 Industries LLC. Over the past eight years, the current owner has been restoring portions of the building while attracting commercial and industrial tenants. Currently, they wish to move away from the previous vision and take a more flexible approach to attract development than the original PUD allowed. Planning staff does not anticipate any negative externalities in the revised vision for the PUD under the new ownership. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their June 14, 2023 Regular Meeting, voted 7-0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications.
