OSTG2023-04, AND APPLICABLE CONDITIONS PERTAINING THERETO, BETWEEN THE CITY OF PUEBLO AND THE COLORADO ASSOCIATION OF TRANSIT AGENCIES, ESTABLISHING PROJECT NO. PT2301, BUDGETING AND APPROPRIATING FUNDS NOT TO EXCEED $414,898.85 INTO PROJECT NO. PT2301, AND RATIFYING THE MAYOR’S SIGNATURE OF THE GRANT AGREEMENT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Grant Agreement awarding Grant No. OSTG2023-04 (“Grant Agreement”) between the City of Pueblo, a Municipal Corporation, and the Colorado Association of Transit Agencies, a true copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved and accepted in accordance with its terms and conditions. SECTION 2. The Mayor’s signature of the Grant Agreement is hereby authorized and ratified, and shall be binding on the City of Pueblo. The Mayor is authorized to execute any and all other certifications, assurances, and other documents associated therewith. SECTION 3. Project Number PT2301 is hereby established, and the amount of $414,898.85 is budgeted and appropriated thereto. SECTION 4. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance and the attached Grant Agreement to implement the policies and procedures described herein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council. PREVIOUS COUNCIL ACTION: FY 2022 Ozone Season Transit Grant OSTG052022 Approval BACKGROUND: This is a FY2023 Ozone Season Transit Grant for $414,898.85. Per Colorado Revised Statute Section 24-38.5-113, Ozone Season Transit Grant Program, the grant provided is 100%, with a 0% match. This grant utilizes funds from the Colorado Energy Office- CASTA Grant Agreement. The grant scope of work includes the Ozone Season Transit Grant Program: $414,898.85 – Estimated Cost ________________________ $414,898.85 Total Grant FINANCIAL IMPLICATIONS: The anticipated total project cost is $414,898.85. The State share is 100% with no City match requirement. BOARD/COMMISSION RECOMMENDATION: Pueblo Transit Board recommends approval. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: The alternative, should this Ordinance not pass, is for the City of Pueblo to not receive its 2023 Ozone Season Transit Grant reimbursement. RECOMMENDATION: Approval of the Ordinance.
