DBA COLORADO BOILER, AND SETTING FORTH $4,083.44 FOR CONTINGENCIES, FOR PROJECT NO. 22-072 (WWAN04) REFURBISHMENT OF BOILER #33 FOR THE JAMES R. DILORIO WATER RECLAMATION FACILITY (WRF) AND APPROVING THE PURCHASING AGENT’S EXECUTION OF THE SAME WHEREAS, an emergency contract amendment was requested by the Director of Wastewater and authorized by the Mayor in accordance with Section 1-10-5 of the Pueblo Municipal Code; and WHEREAS, a construction contract was awarded to GWP Inc. dba Colorado Boiler, under Contract Number 22-072; and WHEREAS, additional work was required to repair Boiler #33; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. City Council ratifies and approves the emergency Contract Amendment No. 1 to the Construction Contract for Refurbishment of Boiler #33 for the James R. DiIorio Water Reclamation Facility (WRF), Project No. 22-072 with GWP Inc. dba Colorado Boiler, in the amount of $20,417.18. SECTION 2. The Purchasing Agent was authorized to execute said contract on behalf of Pueblo, a Colorado Municipal Corporation, and the City Clerk properly affixed the seal of the City thereto and attested the same. SECTION 3. Funds for Project 22-072 (WWAN04) shall be from the Rehabilitation Funds. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this resolution and the contract to implement the transactions described therein. Furthermore, all actions previously taken by officers and staff of the City consistent with the contract amendment, including any payments authorized under the contract amendment, are hereby ratified.’ SECTION 5. This Resolution shall become effective immediately upon passage and approval. DILORIO WATER RECLAMATION FACILITY (WRF) AND APPROVING THE PURCHASING AGENT’S EXECUTION OF THE SAME SUMMARY: This Resolution ratifies and approves the award of an emergency Contract Amendment No. 1 in the amount of $20,417.18 to GWP Inc. dba Colorado Boiler for Project No. 22- 072 (WWAN04) Refurbishment of Boiler #33 for the James R. DiIorio Water Reclamation Facility (WRF) and setting forth $4,083.44 for contingencies on the additional work. PREVIOUS COUNCIL ACTION: Resolution 15022, dated October 11, 2022, awarded a construction contract to GWP Inc. dba Colorado Boiler for Project No. 22-072 (WWAN04) Refurbishment of Boiler #33 for the James R. DiIorio Water Reclamation Facility (WRF). BACKGROUND: The James R. DiIorio Water Reclamation Facility treats wastewater for the City of Pueblo. Boiler #33 is a methane burning boiler used to heat the building and water throughout the plant. Burning methane builds up in the tubes and needs to be scrubbed every year, eating away at the tubes and tube sheet. Boiler #33 tubes and tube sheet are getting thin and need to be replaced, so emergency repairs are not needed to keep the boiler running. If the boiler goes down as our back up, the facility will have to use natural gas as a backup and incur an unforeseen expense during the winter months. During construction, on Wednesday April 19, 2023, as the contractor was preparing the tube sheet to install the new tubes, it was discovered the tube sheet was only 1/2” thick, which did not meet code. The minimum thickness must be 5/8” to install tubes. The contractor could not proceed without the tube sheet being replaced. FINANCIAL IMPLICATIONS: The cost of the amendment to the construction project is $20,417.18 with contingencies of $4,083.44. Funds are available from the Rehabilitation Funds and appropriated to Project No. 22-072 (WWAN04). BOARD/COMMISSION RECOMMENDATION: Not applicable STAKEHOLDER PROCESS: None ALTERNATIVES: Not approve the Resolution, but this would require a finding that there was not an emergency condition. RECOMMENDATION: Approval of the Resolution.
