HomeMy WebLinkAbout15303RESOLUTION NO. 15303 A RESOLUTION APPROVING COMPENSATION WITH RESPECT TO A LEGAL SERVICES AGREEMENT WITH PAUL J. WILLUMSTAD BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. Compensation set forth in the Legal Services Agreement with Paul J. Willumstad, a copy of which is attached hereto, is hereby approved. SECTION 2. Compensation shall be paid from the Professional Services Account of the Law Department or, if necessary, by transfer of any unencumbered appropriation balance or portion thereof from one classification of expenditure to another within the Law Department. SECTION 3. The officers of the City are authorized to perform any and all acts consistent with the intent of this Resolution to effectuate the policies and procedures described herein. SECTION 4. This Resolution shall become effective immediately upon final passage. WILLUMSTAD SUMMARY: This Resolution approves compensation set forth in the Legal Services Agreement with Paul J. Willumstad, a copy of which is attached hereto. PREVIOUS COUNCIL ACTION: Not applicable to this Resolution. BACKGROUND: Pursuant to Section 6-7 of the City Charter, special council is retained solely by the City Attorney, but compensation is approved by City Council. In July of 2023, the Law Department will have a new vacancy in the Assistant City Attorney II position due to resignation and other employment. Special Council is needed to represent the Planning & Development Department, Planning and Zoning Commission, Zoning Board of Appeals and Historic Preservation Commission due to such vacancy and until the position is properly filled. The contract is for six months at monthly compensation of $5,000. Mr. Willumstad had previously performed these services under contract for a period in excess of three decades. FINANCIAL IMPLICATIONS: The agreement will not exceed six months at monthly compensation of $5,000. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: Not applicable to this Resolution. ALTERNATIVES: Not approve the Resolution in which case legal representation of the Planning & Development Department, Planning and Zoning Commission, Zoning Board of Appeals and Historic Preservation Commission may be limited during a transitional period.
