HomeMy WebLinkAbout10487ORDINANCE NO. 10487 AN ORDINANCE ESTABLISHING PROJECT PL2303 - EVALUATION OF LANDFILL OPERATION ALTERNATIVES, TRANSFERRING $150,000 FROM THE UNAPPROPRIATED FUND BALANCE OF THE GENERAL FUND, AND BUDGETING AND APPROPRIATING SAID FUNDS IN THE AMOUNT OF $150,000 TO PROJECT NO. PL2303 BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Evaluation of Landfill Operation Alternatives project, PL2303, is hereby established. SECTION 2. Funds in the amount of $150,000.00 are hereby transferred from the unappropriated fund balance of the General Fund and budgeted and appropriated into the Evaluation of Landfill Operation Alternatives Project No. PL2303. SECTION 3. In accordance with the provisions of Section 6-7 of the Charter of the City of Pueblo, City Council hereby approves compensation for special counsel, if retained by the City Attorney, in an amount not to exceed $50,000.00 for services related to and to be paid from Project No. PL2303. SECTION 4. The officers of the City are authorized to perform any and all acts consistent with this Ordinance to implement the policies and procedures described herein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Action by City Council: Introduced and initial adoption of Ordinance by City Council on June 12, 2023. PL2303 SUMMARY: This Ordinance establishes Project No. PL2303 - Evaluation of Landfill Operation Alternatives, transfers $150,000.00 from the unappropriated fund balance of the General Fund, and budgets and appropriates total funds in the amount of $150,000.00 into the newly-created project account. PREVIOUS COUNCIL ACTION: None. BACKGROUND: Waste Connections has contacted the City requesting a change to the Certificate of Designation for its operations at the South Side Landfill. The potential impacts of this request are significant to the City and its residents and businesses. Outside consultants with specialized experience in landfill design, construction, and management will be required to assist City staff with reviewing Waste Connection's proposals. The project established under this Ordinance will provide funding that will allow the City to engage technical consultants and special counsel to review proposals and information received from Waste Connections and to identify and evaluate a range of strategic alternatives related to landfill and waste management operations benefiting the City for decades to come. FINANCIAL IMPLICATIONS: Funds in the amount of $150,000.00 will be transferred from the unappropriated fund balance of the General Fund and budgeted and appropriated into the newly-created project account. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: Failure to approve this Ordinance will prevent the allocation of funding necessary for the procurement of the technical and legal professional services required to properly evaluate strategic alternatives related to landfill operations and waste management within the City.
