AN ORDINANCE TO ESTABLISH PROJECT NO. WW2304,
BUDGETING AND APPROPRIATING $1,029,328 FROM
PROJECT NO. WW9999 TO PROJECT NO. WW2304 AND
APPROVING AN AGREEMENT FOR PROFESSIONAL
ENGINEERING SERVICES IN THE AMOUNT OF $1,029,328
BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL
CORPORATION, AND BROWN AND CALDWELL, INC., FOR
CONSULTING ENGINEERING SERVICES WITH RESPECT TO
THE SECONDARY CLARIFIERS PROJECT.
WHEREAS, the Pueblo Wastewater Department operates a Water Reclamation Facility
and collection system providing municipal wastewater treatment;
WHEREAS, consulting engineering services are required with respect to the design of
three secondary clarifiers at the James R. DiIorio Water Reclamation Facility;
WHEREAS, Brown and Caldwell is the consulting Engineer of Record and is the most
qualified to serve the Pueblo Wastewater Department for such project; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
An agreement by and between the City of Pueblo, a Municipal Corporation, and Brown
and Caldwell, Inc., a copy of which is attached hereto and made part hereof by reference
(“Agreement”), after having been approved as to form by the City Attorney, is hereby approved.
SECTION 2.
Work Performed under the Agreement may include, but not limited to, the following items:
1. Provide design specifications for the secondary clarifier project
2. Funding Support for both SRF and WIFIA
SECTION 3.
The Mayor is hereby authorized to execute said Agreement on behalf of Pueblo, a
Municipal Corporation, and the City Clerk shall affix the seal of the City thereto and attest the
same.
SECTION 4.
Funds for work performed under this agreement shall be from the Sewer User Fund
Project No. WW9999 to be appropriated to project No. WW2304
SECTION 5.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Ordinance and the Agreement approved to implement the transactions
described therein.
SECTION 6.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

WITH RESPECT TO THE SECONDARY CLARIFIERS PROJECT.
SUMMARY:
This Ordinance accepts an agreement between the City of Pueblo and Brown and
Caldwell, Inc. for consulting engineering services relating to the design of three
secondary clarifiers
PREVIOUS COUNCIL ACTION:
On November 12, 2018, the City Council Approved Resolution No. 14081, selecting
Brown and Caldwell, Inc as the Engineer of Record for the Wastewater Treatment
Department.
BACKGROUND:
The Wastewater Department is requesting design services with respect to constructing
three new clarifiers to comply with the conditions in the dewatering permit for the James
D. DiIorio Water Reclamation Facility wells. The groundwater that is discharged from
the wells has high concentrations of selenium and manganese. The new clarifiers will
be built above the ground water level, so when maintenance is done on the clarifiers
the groundwater does not have to be pumped down by the wells. The design will be
used to apply for funding for this project both through the state revolving fund program
and the federal WIFIA (Water Infrastructure Finance and Innovation Act) program.
FINANCIAL IMPLICATIONS:
The cost of the agreement with Brown and Caldwell to provide design services for the
rehabilitation project will not exceed $1,029,328. Funds will be appropriated from
Projects to be Determined No. WW9999 to Project No. WW2304 from the Sewer Use
Fund.

ALTERNATIVES:
The no-action alternative would cause the James R. DiIorio Water Reclamation Facility
to be out of compliance with the dewatering permit and the State of Colorado to enforce
the facility with fines and other penalties.
RECOMMENDATION:
Approval of the Ordinance.
