HomeMy WebLinkAbout10483 ORDINANCE NO. 10483 AN ORDINANCE APPROVING AN AMENDMENT TO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF PUEBLO AND THE INTERNATIONAL BROTHERHOOD OF POLICE OFFICERS LOCAL 537 RELATING TO RETENTION BONUSES, REDUCTIONS OF STEPS WITHIN THE SALARY SCHEDULE FOR THE POLICE PATROL OFFICER CLASSIFICATION, AND IMPLEMENTING A QUARTERMASTER SYSTEM BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Amendment to the current and successor Collective Bargaining Agreement between the City of Pueblo and the International Brotherhood of Police Officers Local 537, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved and enacted as an Ordinance. SECTION 2. The Mayor is authorized to execute and deliver the Amendment in the name of the City and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. The officers of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to implement the policies and procedures described herein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Action by City Council: Introduced and initial adoption of Ordinance by City Council on June 12, 2023. Gradisar VIA: Marisa Stoller, City Clerk FROM: Nicholas Gradisar, Mayor Bob Jagger, Acting City Attorney Marisa Pacheco, Director Human Resources SUBJECT: AN ORDINANCE APPROVING AN AMENDMENT TO THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY OF PUEBLO AND THE INTERNATIONAL BROTHERHOOD OF POLICE OFFICERS LOCAL 537 RELATING TO RETENTION BONUSES, REDUCTIONS OF STEPS WITHIN THE SALARY SCHEDULE FOR THE POLICE PATROL OFFICER CLASSIFICATION, AND IMPLEMENTING A QUARTERMASTER SYSTEM SUMMARY: Attached is a proposed Ordinance which would amend the current and successor Collective Bargaining Agreement between the City of Pueblo and the International Brotherhood of Police Officers Local 537 as previously approved for 2024. PREVIOUS COUNCIL ACTION: Pursuant to Ordinance No. 9532 approved August 28, 2019, the City entered into a collective bargain agreement (“Agreement”) with the Union for calendar year 2020. The Agreement granted the City the option to extend the Agreement for two successive one- year terms with a 2.75% increase in the salary schedule for 2021 and a 2.5% increase in the salary schedule for 2022. Pursuant to Ordinance No. 9727 approved June 26, 2020, the parties amended and extended the Agreement and provided for no increase in the salary schedule during calendar year 2021. The amendment retained the City’s right to extend or not to extend the Agreement for calendar years 2022 and 2023 at the rates previously agreed upon. Pursuant to Ordinance Nos. 9942 (May 24, 2021) and 10183 (May 23, 2022), the City extended the Agreement for calendar years 2022 and 2023 at the rates previously agreed. Pursuant to Ordinance No. 10211 (June 27, 2022) the City approved an amendment to the Agreement which provided for a 7% wage increase as opposed to a 2.5% wage increase in 2023 and which granted the City the option to extend the Agreement for one successive one-year term. Pursuant to Ordinance No. 10469 (May 8, 2023) the City extended the Agreement for one calendar year, 2024 at the rate previously agreed (5.3% wage increase). BACKGROUND: The City and the Union have been working cooperatively to make positive amendments to the Agreement. Several changes have been agreed to and will become effective pending City Council approval. The terms and conditions of the extended term of the Agreement as approved on May 8, 2023, shall be on the same terms and conditions currently agreed upon except for the following: 1. Amendment of 2023 Police Patrol Officer Salary Schedule The current salary schedule will be reduced from ten steps to eight steps. The first two steps of the current salary schedule will be eliminated with entry level hires beginning at the pay rate assigned currently to Step 3 of the salary schedule. Current incumbents will remain at their current step but within the new salary schedule, which will result in base pay increases. The amended salary schedule for Police Patrol Officer as outlined below will be effective July 1, 2023, if approved. January 1, 2023, Pay Schedule – Police Patrol Officer July 1, 2023, Pay Schedule – Police Patrol Officer 2. Retention Bonus Each Police Patrol Officer, Police Corporal and Police Sergeant employed by the City on July 1, 2023, and covered by this Agreement shall be paid a retention bonus in the amount of Ten Thousand Dollars ($10,000.00), less applicable tax withholdings, payable on the same date that such employee would normally receive the July monthly pay (July 31, 2023). 3. Quartermaster System Both parties recognize that the City is committed to implementing a Quartermaster system as soon as is practical. An official Request for Proposal process is currently underway through the City’s Purchasing Department. This will necessitate a change to Article 21. Uniform and Maintenance of the Agreement as summarized below: A. On or after January 1, 2024, each Police Officer covered by this Agreement shall be credited with Eight Hundred Dollars ($800.00) annually (“Annual Credit”) which will be placed into an account with the Police Department approved vendor for the purchase of uniforms and equipment as may be prescribed by the regulations of the Pueblo Police Department (“Required Uniforms”). The Annual Credit shall not be provided to any entry level Police Officer who has not successfully completed the Police Training Officer Program prior to the first of January of the year of the Annual Credit. The Department reserves the right to require officers to purchase a quantity of specific uniform items not to exceed Eight Hundred ($800). Unused Annual Credit amounts will expire at the end of each year. B. On or after July 2, 2023, and as soon as a quartermaster vendor is selected, each Police Officer covered by the Agreement shall be Four Hundred Dollars ($400.00) (“2023 Credit”) which will be placed into an account for the purchase of approved uniforms and equipment. Any unused portion of the 2023 Credit will expire December 31, 2023. C. Police Officers hired after July 1, 2023, will have their initial Pueblo Police Academy required uniforms items purchased by the City, and prior to graduation, such officers' duty equipment will be issued at no cost to the employee. D. On and after January 1, 2024, each Police Officer covered by the Agreement shall receive an annual allowance of Four Hundred Fifty Dollars ($450.00) for drycleaning, minor maintenance and non-uniform clothing items based on the Police Officer’s assignment. In the event such an employee leaves the service of the City during the ensuing year, the sum of Thirty-Seven Dollars and Fifty Cents ($37.50) shall be deducted from the employee’s final salary payment for each month remaining in that calendar year. FINANCIAL IMPLICATIONS: The total estimated cost of all three cost components as amended in the agreement for FY 2023 is $2,243,673. Specific costs are broken out below: Amendment of 2023 Police Patrol Officer Salary Schedule The cost to amend the salary scale for July 1, 2023, through December 31, 2023, is approximately $ 227,253. Total annualized cost for the changes is estimated to be $454,507 for current incumbents. If fully staffed, the cost annually will be approximately $901,471. Funding for this change will come from the General Fund and the Public Safety Sales Tax fund. Retention Bonus The one-time cost to provide the $10,000 retention bonus to existing Police Officers covered by the Agreement is approximately $1,831,620. 178 (incumbents) x $10,000 + 2.9% Medicare Cost = $1,831,620 The intent is to use ARPA funding to pay this retention bonus. A separate Resolution will be presented to City Council with respect to the retention bonus specifically as it relates to the use of ARPA funding. If such Resolution is not approved, the funding for this will come from the General Fund and the Public Safety Sales Tax Fund. Quartermaster System The cost to provide the annual credits to Police Officers covered by the Agreement is approximately $92,400 for the remainder of 2023. Annual costs are estimated at $184,800. This does not include any costs associated with program administration fees which may be incurred when the quartermaster vendor is identified. Funding for this change will come from the General Fund. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: International Brotherhood of Police Officers Local #537 has agreed to and is supportive of the amendments to the Agreement. ALTERNATIVES: Retain the current Agreement and all terms as approved via ordinance No 10469 on May 8, 2023. RECOMMENDATION: Approval of the Ordinance. ATTACHMENTS: 1. Signed IBPO
