A RESOLUTION AUTHORIZING PAYMENT IN THE AMOUNT OF UP TO
$1,831,620 FROM PROJECT CI2113 - AMERICAN RESCUE PLAN ACT FOR A
ONE-TIME $10,000 RETENTION BONUS TO EXISTING SWORN LINE STAFF,
POLICE OFFICERS, AS AUTHORIZED BY SECTION 603(C)(1)(C) OF THE
AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR
35.6.
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
The transfer of funds in the amount of up to $1,831,620 is hereby authorized from
Project CI2113 - American Rescue Plan Act for a one-time $10,000 retention bonus to existing
sworn line staff, Police Officers.
SECTION 2.
The officers of the City are authorized and directed to perform any and all acts
consistent with the intent of this Resolution to implement the policies and procedures described
herein.
SECTION 3.
This Resolution shall become effective immediately upon final passage.

SUMMARY:
This Resolution authorizes the transfer of funds in the amount of up to $1,831,620 for a
one-time $10,000 retention bonus to existing sworn line staff Police Officers. This
transfer is authorized by Section 603 (C)(1)(C) of the American Rescue Plan Act and
U.S. Treasury Final Rule 31 CFR 35.6.
PREVIOUS COUNCIL ACTION:
Not applicable to this Resolution.
BACKGROUND:
In an effort to retain high quality existing sworn line staff Police Offices, the City and the
International Brotherhood of Police Officers Local #537 have been working
cooperatively to make positive amendments to the collective bargaining agreement.
Included in the agreement is a one-time $10,000 retention bonus to existing sworn line
staff Police Officers. The Retention Bonus is an isolated and unique wage payment
based upon the likely loss of Police Officers and substantiated by Union’s survey and
presentation at the April 24, 2023 City Council Work Session.
The retention bonuses can be an eligible use of ARPA funds under 31C.F.R.
35.6(b)(3)(ii)(E)(4). Treasury will presume that retention incentives that are less than
25 percent of the rate of base pay for an individual employee or 10 percent for a group
or category of employees are reasonably proportional to the need to retain employees,
as long as the other requirements are met. To the extent the $10,000 retention bonus
exceeds 10 percent of the rate of base pay of an individual and the 25% cannot be
justified on an individual basis, the difference will be paid from the General Fund and
Public Safety Tax Fund.
FINANCIAL IMPLICATIONS:
Funding in the amount of up to $1,831,620 will be made available and will be paid out
of Project CI2113 - American Rescue Plan Act.
BOARD/COMMISSION RECOMMENDATION:
None.
STAKEHOLDER PROCESS:
International Brotherhood of Police Officers Local #537 has agreed to and is supportive
of the retention bonuses.
ALTERNATIVES:
City Council could decide not to authorize ARPA funds for retention bonuses.
RECOMMENDATION:
Approval of the Resolution.
