Gradisar VIA: Marisa Stoller, City Clerk FROM: Haley Robinson, Director of Public Affairs AN ORDINANCE APPROVING A PUEBLO MURAL LEVEE PROJECT SUBJECT: AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND DESIREE TALMICH AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: This Ordinance approves a Pueblo Mural Levee Project Agreement with Desiree Talmich in the amount of $5,000 to perform a winning mural upon the Pueblo Levee. PREVIOUS COUNCIL ACTION: Work Session presentation from Haley Sue Robinson and Cynthia Ramu with Pueblo Levee Mural Project on February 21, 2023. BACKGROUND: The City of Pueblo hosted a “call for artists” in fall of 2022 for a Pueblo Levee Mural Project design with the theme of five flags. The theme for the submission includes the five flags which are part of the City Seal with representation of the five territories or countries that held dominion over Pueblo in the last two centuries. The five flags include France, Mexico, Texas, Spain and of course the United States of America. The designs should tell a visual story of the history of Pueblo and represent the community of the city without recreating the official City Seal. Submissions for entry into the mural design contest were due by Friday, Nov. 18. The horizontal format is 24 ft. high by 48-60 ft. wide for painted scale on the levee. All submissions were then evaluated by the Art Review Committee and the final approval of artwork was given by the Pueblo Conservancy District. No logos, religious depictions or trademarked designs shall be included in the design. All artwork must be original to the artist submitting the mural design. Once submissions were completed, the Pueblo Levee Mural Project Coordinator Cynthia Ramu presented the top five designs before Pueblo City Council. It was then determined all of the top five designs would be voted up by the public in order to pick the top artist and mural design. This voting process took place online through the City of Pueblo website www.pueblo.us and through promotion on the social media channels of Twitter, Facebook and Instagram with the use of a Survey Monkey link for the public to cast their vote. Desiree Tamich, had the winning mural design voted for by the public of Pueblo. The contract with the City of Pueblo and Desiree Tamich allows for the transfer of the design in order to carry out the levee mural painting and for the design to be owned by the City of Pueblo. The winning artist will receive a $1,000 stipend and the City of Pueblo will cover the cost up to $4,000 of the mural painting project with supplies and production. FINANCIAL IMPLICATIONS: $2,500 from City Council contingency and $2,500 from Mayor’s contingency BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance STAKEHOLDER PROCESS: All submissions were then evaluated by the Art Review Committee and the final approval of artwork was given by the Pueblo Conservancy District. ALTERNATIVES: Not approve the ordinance in which case the mural project by this artist would not go forward. RECOMMENDATION: Administration recommends approval of this ordinance. ATTACHMENTS: 1. Levee Mural Agreement ORDINANCE NO. 10481 AN ORDINANCE APPROVING A PUEBLO MURAL LEVEE PROJECT AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND DESIREE TALMICH AND AUTHORIZING THE MAYOR TO EXECUTE SAME BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Pueblo Mural Levee Project Agreement (“Agreement”) between and the City of Pueblo, a Colorado Municipal Corporation, and Desiree Talmich attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is hereby authorized to execute said Agreement for and on behalf of the City and the City Clerk is authorized to affix the seal of the City thereto and attest same. SECTION 3. Funds for this Agreement shall be paid from Project CI2321. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance and the attached Agreement to implement the policies and procedures described therein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council.
