Gradisar VIA: Marisa Stoller, City Clerk FROM: Andrew Hayes, Public Works Director SUBJECT: AN ORDINANCE APPROVING A WATER MAIN EXTENSION AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION AND THE BOARD OF WATER WORKS FOR PUEBLO, COLORADO FOR THE EXTENSION OF WATER MAINS IN W. 18TH STREET AND NEWPORT AVENUE AND AUTHORIZING THE MAYOR TO EXECUTE THE SAME SUMMARY: This proposed ordinance will approve a water main extension agreement between the Board of Water Works and the City of Pueblo related to the extension of water mains in W. 18th Street associated with the ongoing road construction project at that location. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The City is currently constructing a two-block segment of W. 18th Street, including the installation of water, sanitary sewer, and stormwater utility infrastructure between Perry Avenue and Sun Mountain Boulevard. The Board of Water Works requires builders to enter into agreements related to the extension of water mains in its water distribution system. The attached agreement generally describes the mains to be installed and their location, references required standards for construction and installation, and requires compliance with Board of Water Works rules and regulations related to the delivery of water service. This Ordinance will approve the agreement and authorize the Mayor to execute the agreement on behalf of the City. FINANCIAL IMPLICATIONS: Under the proposed agreement, the City will not incur any additional costs related to the establishment of water services in the area. The scope of work and approved budget for the road construction project already include sufficient funding for required utility construction activities. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: Failing to approve this Ordinance will preclude the City of Pueblo from being able to complete the installation of water utilities associated with the road construction project on W. 18th Street. RECOMMENDATION: Recommend approval of this Ordinance. The Agreement between the City of Pueblo, a Municipal Corporation, and the Board of Water Works of Pueblo, Colorado, relating to the extension of water mains, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is authorized to execute and deliver the Agreement in the name of the City and the City Clerk is directed to affix the seal of the City thereto and attest same. SECTION 3. The officers of the City are authorized to perform any and all acts consistent with this Ordinance and Agreement to implement the policies and procedures described herein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Action by City Council: Introduced and initial adoption of Ordinance by City Council on May 22, 2023.
