Gradisar VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE APPROVING THE COTTAGES AT PARK WEST SPECIAL AREA PLAN SUMMARY: This Ordinance creates a Special Area Plan consisting of 11.83 acres. PREVIOUS COUNCIL ACTION: The applicant is concurrently requesting to rezone 11.83 acres at the southern portion of Lot 2, Block 1 Park West Business Campus Filing No. 9 and is also requesting to re- subdivide 28.35 acres of the property for future development. BACKGROUND: The Cottages at Park West, A Special Area Plan, is a proposed 11.83-acre residential development located in Lot 1 of the Cottages at Park West, Subdivision. The applicant wishes to create a unique residential development consisting of 97 rentable duplexes all on a single R-5 zoned lot. The duplex units will be accessed from private drives and include common open space and recreation amenities for residents. Lot 1 of the Cottages at Park West Subdivision dedicates an 18-foot western extension of Sanchez Lane, that terminates in a cul-de-sac. Sanchez Lane continues west as a private street with a roundabout constructed at the terminus. Private drive, Switchgrass Circle will intersect with Sanchez Lane and provide internal circulation and access to the individual dwelling units. Private drive, Blue Avena Lane will provide an east/west connection within the development. FINANCIAL IMPLICATIONS: None. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their October 12, 2022 Regular Meeting, voted 7-0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance, a Special Area Plan will not be created. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance. SAP-22-01 Attachments ORDINANCE NO. 10475 AN ORDINANCE APPROVING THE COTTAGES AT PARK WEST SPECIAL AREA PLAN WHEREAS, a request for a Special Area Plan for Cottages at Park West, A Special Area Plan, has been submitted to the Planning and Zoning Commission for approval pursuant to Section 17-4-29 of the Pueblo Municipal Code, and, WHEREAS, the Planning and Zoning Commission after a public hearing found and determined the objectives and requirements of said Section 17-4-29 can and will be met, and, WHEREAS, the Planning and Zoning Commission has recommended the approval of the Special Area Plan for Cottages at Park West, A Special Area Plan, NOW, THERFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Special Area Plan for: LOT 2, BLOCK 1, PARK WEST BUSINESS CAMPUS FILING NO. 9, RECORDED OCTOBER 01, 2014 IN THE OFFICE OF THE PUEBLO COUNTY CLERK AND RECORDER UNDER RECEPTION NO. 1986430, CITY AND COUNTY OF PUEBLO, STATE OF COLORADO. CONTAINING A PLAITED AREA OF 1,235,099 SQUARE FEET OR (28.35397 ACRES). attached hereto, is hereby approved. SECTION 2. The Cottages at Park West Special Area Plan is approved without conditions. SECTION 3. This Ordinance shall become effective immediately upon final passage and approval. Action by City Council: Introduced and initial adoption of Ordinance by City Council on May 22, 2023.
