AN ORDINANCE APPROVING AND ACCEPTING A
CONGRESSIONALLY DIRECTED SPENDING (CDS) PROGRAM
AWARD IN THE AMOUNT OF $86,000.00 FOR A 3D FARO
SCANNER AND ASSOCIATED TRAINING, ESTABLISHING
PROJECT NUMBER PS2305, AND BUDGETING AND
APPROPRIATING GRANT FUNDS OF $86,000.00 TO SAID
PROJECT
WHEREAS, the City Council of Pueblo has the authority on behalf of the City of Pueblo,
including its Police Department, to accept grants for public and municipal purposes and to enter
into agreements relating thereto; and
WHEREAS, the United States Congressionally Directed Spending (C.D.S.) Program
has tendered an award for a 3D FARO Scanner and training for the use thereof in the amount of
$86,000.00; and
WHEREAS, acceptance of the award for the purposes for which it has been made is in
the best interest of the City and will benefit the health, welfare, and safety of the citizens of the
City; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The award of a Congressionally Directed Spending (C.D.S.) Grant for 3D Faro Scanner
Technology to the City of Pueblo, as designated on page 112 in the December 20, 2022
Congressional Record, a copy of which is attached hereto, is hereby approved and accepted.
SECTION 2.
Should it be necessary, the Mayor of the City is authorized to execute a grant award
acceptance in the name of and on behalf of the City, and the Mayor is further authorized to
execute any and all other certifications, assurances, and other documents associated therewith.
SECTION 3.
Project Number PS2305 is hereby established, and the amount of $86,000 is budgeted
and appropriated thereto.
SECTION 4.
The officer and staff of the City are authorized to perform any and all acts consistent with
the intent of this Ordinance and the attached award to implement the policies and procedures
described herein.
SECTION 5.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
The United States Congress grants Congressionally directed awards to be spent by the
recipient for specific projects. These awards do not mandate any additional
government spending.
PREVIOUS COUNCIL ACTION:
There has been no previous Council action with respect to this Ordinance.
BACKGROUND:
In March of 2022 the City of Pueblo Grant and Resource Development Administrator
applied to the Congressionally Directed Spending (C.D.S.) Program requesting funding
in the amount of $86,000 to the City of Pueblo to fund the purchase of a 3D FARO
Scanner, scanning equipment, software, and training for up to 6 investigators in the use
of the equipment and software technology. In February of 2023 notification was
received that funding for this project was approved through the Congressionally
Directed Spending Program (see attached documents).
Acquisition of a 3D FARO Scanner will allow PPD to more accurately and efficiently
document, measure, and reconstruct both criminal incident and traffic crash scenes.
The Scanner allows for a 3D representation of the scene to be preserved for evidence
purposes. Finally, the Scanner will create greater labor efficiencies as PPD personnel
will not need to hold a scene for an extended period while waiting on another agency to
respond.
FINANCIAL IMPLICATIONS:
There is no financial impact to the City of Pueblo as the expenses are funded by grant
funds. No City matching funds are required.

Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
None.
ALTERNATIVES:
The Council may disapprove the agreement and thereby decline the award.
RECOMMENDATION:
Passage of this Ordinance is recommended.
