A RESOLUTION RECOGNIZING POLICE COMFORT K-9 AMI IS
UNABLE TO PERFORM AS A COMFORT ANIMAL, ALLOWING
THE CITY OF PUEBLO TO DONATE K-9 AMI VIA AN
ACKNOLEDGEMENT, ASSUMPTION OF RISK, WAIVER,
RELEASE, COVENANT NOT TO SUE, INDEMNIFICATION, AND
AGREEMENT BETWEEN THE CITY OF PUEBLO AND MONICA
LEMMON RELATING TO K-9 AMI, AND ALLOWING THE
POLICE DEPARTMENT TO TRANSFER OWNERSHIP AND
LIABILITY OF K-9 AMI TO HIS CURRENT HANDLER
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
The Acknowledgement, Assumption of Risk, Waiver, Release, Covenant Not To Sue,
and Agreement between the City of Pueblo and Comfort K-9 handler Monica Lemmon
(“Agreement”) relating to Comfort K-9 Ami, a copy of which is attached hereto, having been
approved as to form by the City Attorney, is hereby approved.
SECTION 2.
The officers and staff of the City are directed and authorized to perform any and all acts
consistent with the intent of this Resolution and the attached Agreement to implement the
transaction described therein.
SECTION 3.
This Resolution shall become effective immediately upon final passage.

PUEBLO AND MONICA LEMMON RELATING TO K-9 AMI, AND
ALLOWING THE POLICE DEPARTMENT TO TRANSFER OWNERSHIP
AND LIABILITY OF K-9 AMI TO HIS CURRENT HANDLER
SUMMARY:
Attached is an Acknowledgement, Assumption of Risk, Waiver, Release, Covenant Not
To Sue, Indemnification, and Agreement between the City of Pueblo and current
Comfort K-9 handler Monica Lemmon concerning the transfer of Comfort K-9 Ami by
the City of Pueblo to current handler Monica Lemmon. Monica Lemmon has signed an
agreement releasing the City of Pueblo of any liability or responsibility for K-9 Ami (see
attached) against the City of Pueblo.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
On September 5, 2021, Fuzzybottoms Poodles & Berdedoodles donated K-9 Ami to the
Pueblo Police Department for the purpose of establishing a comfort dog. Police
Comfort K-9 Ami did not pass the training necessary to become a certified Comfort K-9.
K-9 Ami has also been assigned to two different handlers in the past two months,
causing anxiety and mental stress. The Police Department has donated police dogs in
the past to employee handlers for the best interest of the K-9’s mental health when they
are no longer able to work.
