HomeMy WebLinkAbout10451ORDINANCE NO. 10451 AN ORDINANCE APPROVING A FACILITY USE AGREEMENT BETWEEN PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND GREYHOUND LINES, INC., AND AUTHORIZING THE MAYOR TO EXECUTE SAME BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Facility Use Agreement (“Agreement”), between Pueblo, a Municipal Corporation, and Greyhound Lines, Inc., attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is hereby authorized to execute said Agreement for, and on behalf of the City, and the City Clerk is authorized to affix the seal of the City thereto and attest same. SECTION 3. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance and the attached Agreement to implement the policies and procedures described therein. SECTION 4. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Benjamin Valdez SUBJECT: AN ORDINANCE APPROVING A FACILITY USE AGREEMENT BETWEEN PUEBLO, A COLORADO MUNICIPAL CORPORATION, AND GREYHOUND LINES, INC., AND AUTHORIZING THE MAYOR TO EXECUTE SAME SUMMARY: Attached is a Facility Use Agreement between the City of Pueblo and Greyhound Lines, Inc. for providing bus loading and unloading parking at the Transit Center at 123 Court Avenue. PREVIOUS COUNCIL ACTION: The City and Greyhound Bus Lines, Inc. entered into a “Revenue Agreement” dated February 15, 2011, in which Pueblo Transit handled all of the Greyhound operations to include ticket sales, freight and luggage handling. BACKGROUND: The original agreement was not able to be amended to make this continued service viable for both parties. Attached is a proposed agreement which allows for facility use only and subject to the terms and conditions therein set forth. FINANCIAL IMPLICATIONS: Greyhound Lines, Inc. will pay $21,000 to the City of Pueblo for the Use of the Facility. BOARD/COMMISSION RECOMMENDATION: Pueblo Transit Board recommends approval. STAKEHOLDER PROCESS: Not applicable. ALTERNATIVES: Should this Ordinance not pass, Greyhound Lines, Inc. will no longer have access and use of the Facility. RECOMMENDATION: Approval of the Ordinance.
