HomeMy WebLinkAbout10446ORDINANCE NO. 10446 AN ORDINANCE AMENDING THE FISCAL YEAR 2023 STAFFING ORDINANCE BY TEMPORARILY ADDING A POSITION WITHIN THE LAW DEPARTMENT FOR TRAINING PURPOSES WHEREAS, it is necessary to revise the positions for the ultimate efficiency and functionality for the Law Department; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The following section captioned “Law Department” “of Ordinance No. 10363, being the 2023 Staffing Ordinance, is amended as follows: The following positions shall be authorized for FY 2023: SECTION 2. Effective December 1, 2023, the position established pursuant to above Section 1 shall be abolished and the 2023 Staffing Ordinance shall be amended as follows: SECTION 3. The officers and staff of the City are directed and authorized to perform any and all acts consistent with the intent of this Ordinance to implement and transactions described therein. SECTION 4. This Ordinance shall be deemed to amend the Fiscal Year 2023 Budget and staffing with respect to the number and allocation of positions within Law Department and shall become effective on the date of final action by the Mayor and City Council. Kogovsek, City Attorney Marisa Pacheco, Director Human Resources SUBJECT: AN ORDINANCE AMENDING THE FISCAL YEAR 2023 STAFFING ORDINANCE BY TEMPORARILY ADDING A POSITION WITHIN THE LAW DEPARTMENT FOR TRAINING PURPOSES SUMMARY: The City Attorney, with Mayor Gradisar’s approval, requests to temporarily increase the staffing level of the Law Department by one (1) full time equivalent (FTE) for training purposes. The classification shall be Legal Assistant and the additional FTE shall be abolished upon the anticipated retirement of the current incumbent in the position effective December 1, 2023 upon her retirement. PREVIOUS COUNCIL ACTION: On December 27, 2022, Ordinance No. 10363 was approved by City Council. This Ordinance provided authorized staffing for Fiscal Year 2023. BACKGROUND: The Legal Assistant for the City has announced plans to retire at the end of November 2023 after a distinguished career with the City of over 30 years. There is no mechanism in ordinance to allow for temporary overfilling of a position in order to facilitate critical training and transition activities. Therefore, the department requests the addition of a Legal Assistant FTE on a temporary basis to accomplish the necessary training. It is anticipated that the position requested by this ordinance will be posted in the next several months and will then be filled in August to allow for several months of overlap prior to the current incumbent’s departure. It is further requested that the additional FTE be abolished upon separation of the current Legal Assistant via retirement. FINANCIAL IMPLICATIONS: Funding for the wages and benefits for the position will come from the General Fund. The cost for the four months of the additional position is approximately $30,418 and can be absorbed by the Law Department’s 2023 budget through salary and operational savings, pending City Council approval. BOARD/COMMISSION RECOMMENDATION: Not applicable STAKEHOLDER PROCESS: None ALTERNATIVES: The no-action alternative would be to retain the current staffing level, which would eliminate any opportunity to train a newly hired Legal Assistant, which would be undesirable.
