HomeMy WebLinkAbout10436ORDINANCE NO. 10436 AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE 2001, 2005, 2009 OAKLAND AVENUE, LOTS 1 THROUGH 3 BLOCK 1, CF&I CORPORATION SUBDIVISION, FROM R-2, SINGLE FAMILY RESIDENTIAL AND O-1, NEIGHBORHOOD OFFICE TO R-5, MULTIPLE RESIDENTIAL AND OFFICE ZONE DISTRICT BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The zoning restrictions covering the following described property, and in addition half of all adjacent dedicated roadway and alley rights-of-way, together generally identified in the attached Rezone Exhibit, is hereby changed from R-2, Single Family Residential and O-1, Neighborhood Office Zone District to R-5, Multiple Residential and Office Zone District: Lot 1-3, Block 1, CF&I Corporation Subdivision SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE 2001, 2005, 2009 OAKLAND AVENUE, LOTS 1 THROUGH 3 BLOCK 1, CF&I CORPORATION SUBDIVISION, FROM R-2, SINGLE FAMILY RESIDENTIAL AND O-1, NEIGHBORHOOD OFFICE TO R-5, MULTIPLE RESIDENTIAL AND OFFICE ZONE DISTRICT SUMMARY: The applicant is requesting to rezone 2001, 2005, 2009 Oakland Avenue, Lots 1 through 3 Block 1, CF&I Corporation Subdivision, from R-2, Single Family Residential and O-1, Neighborhood Office to R-5, Multiple Residential and Office Zone District, on behalf of the Sisters of Charity Health Services PREVIOUS COUNCIL ACTION: None. BACKGROUND: Pueblo Community College is opening a new Nursing and Allied Health Teaching and Learning Center at St. Mary Corwin Hospital. The property proposed to be rezoned will be redeveloped as a surface parking lot for the nursing students to minimize adverse impacts on existing parking facilities at the hospital. The project will involve demolition of three single family homes, constructed in the 1940’s and currently owned by the hospital. 2001 Oakland Avenue is zoned O-1, and previously operated as an administrative office. 2005 and 2009 Oakland Avenue are currently zoned R-2 and were used as residences. At the February 8, 2023 Planning and Zoning Commission hearing four residents of the homes adjacent to the property proposed to be rezoned spoke in opposition to the rezoning request based on the impact of a parking lot to the residential character of the neighborhood and additional traffic the parking lot could generate on Oakland Avenue. Oakland Avenue is a one-way street extending south from Minnequa Avenue to Indiana Avenue. The intent of the R-5 Zone District is to provide “areas of high-density multifamily dwelling structures with limited comingling of professional offices and studios”. These developed neighborhoods have a traditional neighborhood pattern with a diversity of affordable housing types on a variety of lot sizes with small lots predominating.” The R-5 Zone District does allow for a wide variety of complimentary uses to support multifamily, and office uses including hospitals and parking lots which are all uses by right. As a new use in the R-5 Zone District, the parking lot will need to be landscaped in accordance with Sec. 17-4-7 of the Pueblo Municipal Code and meet all other development regulations. The Traffic Department recommended the parking lot ingress/egress be located as far away from the intersection of Oakland Avenue and Minnequa Avenue as possible. Access points and landscaping will be reviewed at the time of commercial site plan review. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their February 8, 2023 Regular Meeting, voted 4-3 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications.
