HomeMy WebLinkAbout10418ORDINANCE NO. 10418 AN ORDINANCE APPROVING AND AUTHORIZING THE MAYOR TO SIGN AN AMENDMENT TO A SUBRECIPIENT AGREEMENT BETWEEN THE CITY OF PUEBLO, A COLORADO MUNICIPAL CORPORATION AND POSADA, INC., A COLORADO NONPROFIT CORPORATION, AS AUTHORIZED BY SECTION 603 OF THE AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL RULE 31 CFR 35.6 AND AUTHORIZING THE PAYMENT OF AN ADDITIONAL FIFTY THOUSAND DOLLARS ($50,000) FROM PROJECT NO. CI2113 - AMERICAN RESCUE PLAN ACT, FOR PURPOSES THEREOF WHEREAS, the Parties entered into a Subrecipient Agreement dated February 13, 2023 (the “Agreement”) which was approved by the Pueblo City Council on February 13, 2023 by emergency Ordinance No. 10384; and WHEREAS, the purpose of this Amendment is to increase the amount of funds available for the Subrecipient’s Project; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that: SECTION 1. The Amendment to Subrecipient Agreement (“Amendment”) dated March 27, 2023, between the City of Pueblo, a Colorado municipal corporation and Posada, Inc., a Colorado nonprofit corporation, a copy of which is attached hereto, having been approved as to form by the City Attorney, is hereby approved. SECTION 2. The Mayor is hereby authorized to execute said Amendment for and on behalf of the City and the City Clerk is authorized to affix the seal of the City thereto and attest same. SECTION 3. Additional funds in the amount of $50,000 are hereby authorized to be paid from Project No. CI2113 – American Rescue Plan Act, to provide emergency housing assistance, including hotel vouchers, to tenants displaced from the Skyview Apartments as a result of the catastrophic breakdown of the apartment complex’s heating and sewer systems. SECTION 4. The officers and staff of the City are authorized to perform any and all acts consistent with this Ordinance and the attached Amendment to implement the policies and procedures described herein. SECTION 5. This Ordinance shall become effective on the date of final action by the Mayor and City Council. CI2113 - AMERICAN RESCUE PLAN ACT, FOR PURPOSES THEREOF SUMMARY: This Ordinance approves and authorizes the Mayor to sign an Amendment to a Subrecipient Agreement with Posada, Inc., a Colorado nonprofit corporation (“Posada”) to provide additional funds for emergency housing assistance, including hotel vouchers, to tenants displaced from the Skyview Apartments as a result of the catastrophic breakdown of the apartment complex’s heating and sewer systems (hereinafter “Project”) as authorized by Section 603 of the American Rescue Plan Act and U.S. Treasury Final Rule 31 CFR 35.6. Additional Funds for the Project, in the amount of $50,000 will be paid out of Project No. CI2113, the American Rescue Plan Act. PREVIOUS COUNCIL ACTION: The City and Posada entered into a Subrecipient Agreement dated February 13, 2023 (the “Agreement”) which was approved by the Pueblo City Council on February 13, 2023 by emergency Ordinance No. 10384. BACKGROUND: The purpose of this Amendment is to increase the amount of funds available for the Project. FINANCIAL IMPLICATIONS: Posada will receive an additional $50,000 in ARPA funds from Project No.CI2113. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Ordinance. STAKEHOLDER PROCESS: Not applicable to this Ordinance. ALTERNATIVES: City Council could decide not to provide the additional $50,000 in emergency housing assistance, including hotel vouchers, to tenants displaced from the Skyview Apartments.
