HomeMy WebLinkAbout15169RESOLUTION NO. 15169 A RESOLUTION CONCERNING THE ASSESSMENT OF COSTS FOR THE DEMOLITION AND ABATEMENT OF DANGEROUS STRUCTURES UPON THE PROPERTIES LOCATED AT 1608 WABASH AVENUE AND 1103 EAST 8TH STREET WITHIN THE CITY OF PUEBLO AND SETTING A DATE FOR COUNCIL HEARINGS THEREON WHEREAS, pursuant to Chapter 13 of Title IV of the Pueblo Municipal Code and Chapter 8 of the Uniform Code for Abatement of Dangerous Buildings, as adopted and amended, the Director of Public Works has caused the demolition and removal of buildings and structures found to be dangerous; and, WHEREAS, the Director of Public Works has filed his reports with respect to the costs thereof with the City Clerk, copies of which are attached hereto and incorporated herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. Hearings on the assessment of such costs and on any property owners' or agents' complaints, objections, or protests to the costs of demolition and removal of buildings and structures is hereby scheduled to be held before the City Council on Monday, the 27th day of March, 2023, commencing at 7:00 p.m., or as soon thereafter as permitted by the Business of City Council, in the Council Chambers, 3rd floor, 1 City Hall Place, Pueblo, CO 81003. SECTION 2. The City Clerk shall notify the owners or agents of the properties to be assessed, as shown in the report of the Director of Public Works, that such demolitions and removals have been completed, and specify: (a) The entire cost of the demolition and removal of dangerous structures at 1608 Wabash Avenue will be $56,272.23 plus notification and filing costs; (b) The entire cost of the demolition and removal of dangerous structures at 1103 E. 8th Street will be $36,609.99 plus notification and filing costs; (c) Any complaints, objections, or protests shall be made IN WRITING by the owners or agents, to the City Council and filed in the office of the City Clerk prior to the time set for hearing as indicated in Section 1 of this Resolution; and (d) That up on the day and hour for hearing, the City Council will hear and pass upon the report from the Director of Public Works, together with any objections or protests which may be filed by any person interested in or affected by the proposed assessment of costs. SECTION 3. The officers of the City are authorized to perform any and all acts consistent with this Resolution to implement the policies and procedures described herein. SECTION 4. This Resolution shall become effective immediately upon passage and approval. Gradisar VIA: Marisa Stoller, City Clerk FROM: Andrew Hayes, Public Works Director SUBJECT: A RESOLUTION CONCERNING THE ASSESSMENT OF COSTS FOR THE DEMOLITION AND ABATEMENT OF DANGEROUS STRUCTURES UPON THE PROPERTIES LOCATED AT 1608 WABASH AVENUE AND 1103 EAST 8TH STREET WITHIN THE CITY OF PUEBLO AND SETTING A DATE FOR COUNCIL HEARINGS THEREON SUMMARY: This resolution will set a date for public hearings regarding the assessment of costs for the demolition of dangerous structures at 1608 Wabash Avenue and 1103 East 8th Street in the City of Pueblo. PREVIOUS COUNCIL ACTION: On November 23, 1998, by Ordinance No. 6369, City Council adopted with modifications the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition. On September 13, 2021, by Resolution No. 14699, City Council approved the award of a building demolition contract including the abatement of dangerous buildings on the properties located at 1608 Wabash Avenue and 1103 East 8th Street. BACKGROUND: Pursuant to Chapter 13 of Title IV of the Pueblo Municipal Code and Chapter 8 of the Uniform Code for Abatement of Dangerous Buildings, the Building Official has determined the building(s) located at 1608 Wabash Avenue and 1103 East 8th Street, respectively, were in a dangerous condition, and after giving proper notice to the owners, requested the City of Pueblo to demolish these buildings. The buildings have been demolished, and the costs incurred by the City of Pueblo have been compiled by the Director of Public Works in a Report of Demolition. In accordance with Section 903 of the Uniform Code for the Abatement of Dangerous Buildings, 1997 Editions (as amended), a public hearing is required prior to making an assessment to recover costs related to demolition work performed by the City of Pueblo. Passage of this resolution will set a date for the required public hearings so City Council may hear the Reports of Demolition as well as any complaints, objections, or protests filed by interested parties related to the projects. FINANCIAL IMPLICATIONS: Passage of this Resolution will have no direct financial impact upon the City of Pueblo. BOARD/COMMISSION RECOMMENDATION: Not applicable to this Resolution. STAKEHOLDER PROCESS: The properties at 1608 Wabash Avenue and 1103 East 8th Street were inspected by the Building Official of Pueblo Regional Building Department. Following the inspections, a condemnation Notice and Order was served and posted, as required, for each property and the respective property owners were provided an opportunity to appeal their Notice and Order. The property owners failed to make the required repairs or to abate the dangerous buildings on their properties. The Notice and Order documents were recorded for each property in the records of the Pueblo County Clerk and Recorder. The cases were then referred to the City of Pueblo with a request from the Building Official for the City to abate the dangerous buildings on the said properties. The demolition work at 1608 Wabash Avenue was completed in February 2022, and the total cost incurred by the City was $56,272.23. The demolition work at 1103 East 8th Street was completed in December 2021, and the total cost incurred by the City of Pueblo was $36,609.99. ALTERNATIVES: If this resolution is not approved, the City of Pueblo will not be able to hold the public hearings required under Section 903 of the Uniform Code for the Abatement of Dangerous Buildings prior to assessing the demolition project costs and the City will not recover the costs associated with the completed projects.
