HomeMy WebLinkAbout15165RESOLUTION NO. 15165 A RESOLUTION RATIFYING AN EMERGENCY CONSTRUCTION CONTRACT IN THE AMOUNT OF $79,440 TO RUSS GRADING & EXCAVATING, INC., FOR PROJECT NO. 23-027, EMERGENCY BID FOR CITY PARK ZOO CANAL PIPELINE REPLACEMENT, SETTING FORTH $7,944 FOR CONTINGENCIES, AND AUTHORIZING THE PURCHASING AGENT TO EXECUTE SAME WHEREAS, an emergency City improvement contract was requested by the Director of Public Works and authorized by the Mayor in accordance with Section 1-10-5 of the Pueblo Municipal Code for Project No. 23-027, Emergency Bid for City Park Zoo Canal Pipeline Replacement; WHEREAS, the proposal of Russ Grading & Excavating, Inc., was the lowest of those bids determined to be responsive and was determined to be the proposal which will achieve maximum economy to the City under the conditions prevailing; and WHEREAS, an emergency construction contract to complete the pipeline replacement was there upon awarded to Russ Grading & Excavating, Inc., under Contract Number 23-027; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that SECTION 1. City Council ratifies and approves the contract for the pipeline replacement at City Park Zoo Canal with Russ Grading & Excavating, Inc., Project No. 23-027, Emergency Bid for City Park Zoo Canal Pipeline Replacement project awarded to said contractor in the amount of $79,440.00. SECTION 2. The Purchasing Agent was authorized to execute said contract on behalf of Pueblo, a municipal corporation, and the City Clerk was authorized to affix the seal of the City thereto and attest same. SECTION 3. In addition to the amount of the bid set forth, as aforementioned, an additional amount as stipulated in this section is hereby established for contingencies and additional work. Contingencies and Additional Work………$7,944.00 SECTION 4. Funds for Project No. 23-027 (including contingencies and additional work) shall be from account 50161100-57970. SECTION 5. The officers and staff of the City of Pueblo are authorized to perform any and all acts consistent with the intent of this Resolution and the contract to implement the transactions described herein. Furthermore, all actions previously taken by officers and staff of the City consistent with the contract, including any payments authorized under the contract, are hereby ratified. SECTION 6. This Resolution shall become effective immediately upon passage and approval. PREVIOUS COUNCIL ACTION: None. BACKGROUND: Horseshoe Lake, located near the City Park Zoo and Tennis Courts, is used to irrigate the Elmwood golf course and is filled by a canal that meanders through the Pueblo Zoo. Water for this canal is fed from the Bessemer Ditch by an existing 18 inch corrugated metal pipe and an open channel. This existing 18 inch CMP is failing. This project will fix the failing pipe by replacing it and the canal with a new 18" diameter plastic pipe. This project will consist of removing 361 L.F. of 18" Diameter Corrugated Metal Pipe and installing 60 L.F. of 18" Diameter Polypropylene (PP) pipe, 480 L.F. of high-density Polyethylene (HDPE) pipe, importing of fill material and other incidental items as shown in the plans and specifications. The Resolution ratifies the emergency construction contract that was awarded to Russ Grading & Excavating, Inc. FINANCIAL IMPLICATIONS: Funding (including contingencies) in the amount of $87,384.00 will be paid from account 50161100-57970. BOARD/COMMISSION RECOMMENDATION: None. STAKEHOLDER PROCESS: None. ALTERNATIVES: Not approving this Resolution would require a finding that there was not an emergency condition. RECOMMENDATION: Approval of the Resolution.
