AN ORDINANCE APPROVING AND ACCEPTING A 2022
COLORADO JUSTICE ASSISTANCE GRANT (2022 JAG)
IN THE AMOUNT OF $10,000 FOR 3D FARO SCANNER
TRAINING, AUTHORIZING THE MAYOR TO EXECUTE
THE GRANT AWARD LETTER AND RELATED
DOCUMENTS, ESTABLISHING PROJECT NO. PS2303,
AND BUDGETING AND APPROPRIATING THE GRANT
FUNDS OF $10,000 TO SAID PROJECT
WHEREAS, the City Council of Pueblo has the authority on behalf of the City of
Pueblo, including its Police Department, to accept grants for public and municipal
purposes and to enter into agreements relating thereto; and
WHEREAS, the Colorado Justice Assistance Grant program has tendered an
award (“Award”) for Project No. 2021-JI-22-01-20-1 / 3D FARO Scanner Technology
(Pueblo) in the amount of $10,000.00 upon conditions recited therein or incorporated
therein by reference; and
WHEREAS, acceptance of the Award for the purposes for which it has been
made is in the best interest of the City and will benefit the health, welfare, and safety of
the citizens of the City. NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Grant Award Letter (Intergovernmental Grant Agreement), DCJ Grant No.
2021-JI-22-01-20-1, (“Agreement”) between the State of Colorado, Department of
Public Safety, Division of Criminal Justice, and the City of Pueblo, a Municipal
Corporation, for 3D FARO Scanner Technology training, a true copy of which is
attached hereto, having been approved as to form by the City Attorney, is hereby
approved.
SECTION 2.
The Mayor is hereby authorized to execute the Agreement and related
documents in the name and on behalf of the City of Pueblo, where the Mayor may
execute the Agreement and related documents by electronic signature and such
electronic signature shall be attributable to the Mayor and the City of Pueblo.
SECTION 3.
Project No. PS2303 is hereby established.
SECTION 4.
Grant funds in the amount of $10,000.00 shall be accepted pursuant to the
Agreement and budgeted and appropriated to Project No. PS2303.
SECTION 5.
Pursuant to the Agreement, the State of Colorado, Department of Public Safety,
Division of Criminal Justice, (“State”) may unilaterally amend the terms of the
Agreement or the amount of grant funds pursuant to an updated Grant Award Letter or
other change letter. In the event the State increases the grant award via such a letter,
the additional funds may be accepted pursuant to this Ordinance and budgeted and
appropriated into Project No. PS2303, where said funds shall only be expended and
used for this project.
SECTION 6.
The officers and staff of the City are hereby authorized to perform any and all
acts consistent with this Ordinance and the attached Agreement and documents to
implement the transactions described therein.
SECTION 7.
The Ordinance shall become effective on the date of final action by the Mayor
and City Council.

SUMMARY:
Attached is a 2022 Colorado Justice Assistance Grant (JAG) and the related Grant
Award Letter for Project No. 2021-JI-22-01-20-1 / 3D FARO Scanner Technology
(Pueblo) and accompanying documents.
PREVIOUS COUNCIL ACTION:
On November 28, 2022, City Council passed Ordinance No. 10346, which approved
and ratified a Memorandum of Understanding (MOU) between the Pueblo County
Sheriff and the City of Pueblo for use of the Pueblo County Sheriff’s 3D FARO Scanner
Technology.
BACKGROUND:
The Edward Byrne Memorial Justice Assistance Grant (JAG) Program provides funds
to units of local government for the purpose of improving law enforcement technology
and upgrading necessary equipment. The program is designed to help local
communities address problems specific to their areas.
Pursuant to a related Colorado Justice Assistance Grant, immediate signature of the
MOU was needed so that the Pueblo Police Department could obtain grant funding.
Acceptance of the JAG grant is now needed to obtain funding for 3D FARO Scanner
training.
Acceptance of the award and scheduling of and budgeting for the 3D FARO
Technology training will be based upon adoption of this Ordinance, establishing Project
No. PS2303, and budgeting and appropriating funds in the amount of $10,000.00 into
project PS2303. This project will fund a FARO Technologies Inc. training representative
to travel to Pueblo and provide five days of on-site, hands-on training on the use of the
3D FARO Scanner Technology for up to six attendees.
FINANCIAL IMPLICATIONS:
If approved, grant funds in the amount of $10,000.00 will be budgeted and appropriated
into Project No. PS2303 to fund the training. Reimbursement of the $10,000.00 will be
made to the City of Pueblo through the Edward Byrne Memorial Justice Assistance
Grant. There is no City match required.
BOARD/COMMISSION RECOMMENDATION:
Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
City and County law enforcement leaders have met and agreed to the terms of training
and use of the equipment outlined in this proposed Ordinance as well as Ordinance No.
10346.
ALTERNATIVES:
If the grant funds are not accepted, the City of Pueblo would need to use $10,000.00 in
municipal funds to train Police Department personnel on the 3D FARO Scanner
Technology.
RECOMMENDATION:
Approval of the Ordinance.
