The zoning restrictions covering the following described property, and in addition half of all adjacent dedicated roadway and alley rights-of-way, together generally identified in the attached Rezone Exhibit, is hereby changed from R-2, Single Family Residential to RCN, Residential Charter Neighborhood: Lots 8 and 9, Block 20, Mattices Subdivision SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of the Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective immediately upon final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE AMENDING ZONING RESTRICTIONS TO REZONE 612 EAST 2ND STREET, LOTS 8 AND 9 BLOCK 20, MATTICES SUBDIVISION, EAST PUEBLO HEIGHTS, FROM R-2, SINGLE FAMILY RESIDENTIAL TO RCN, RESIDENTIAL CHARTER NEIGHBORHOOD SUMMARY: nd The City is requesting to rezone 612 East 2 Street, lots 8 and 9 block 20, Mattices Subdivision, East Pueblo Heights, from R-2, Single Family Residential to RCN, Residential Charter Neighborhood for future development. PREVIOUS COUNCIL ACTION: None. BACKGROUND: The City of Pueblo demolished a condemned residence located at 612 East 2nd in 2007. In 2012, the City acquired the property through a Treasurers Deed due to unpaid taxes and liens. Pueblo Urban Renewal Authority (PURA) approached the Department of Housing and Citizen Services to acquire the property to develop a single-family attached residence on the parcel. The single family attached residence will include two separate dwelling units on each lot (lots 8 and 9), the dwelling units will be attached by a common wall but sold separately. The Residential Charter Neighborhood (RCN) Zone District allows single-family attached residences as a use by right, the existing R-2, Single Family Residential District allows a residence, two-family as a use by review, requiring Zoning Board of Appeals approval. Because PURA would like to sell the individual units, the RCN Zone District is a more appropriate zone district for the preferred development. The intent of the RCN Zone District is to “maintain the character of the City’s original neighborhoods, sometimes referred to as Charter Neighborhoods, while meeting modern needs and standards. These developed neighborhoods have a traditional neighborhood pattern with a diversity of affordable housing types on a variety of lot sizes with small lots predominating.” Development within the 600 Block of East 2nd Street consists of primarily single-family homes on a variety of lot sizes. Presently, there are three single-family residences that occupy 25 by 120- foot lots within the 600 Block of East 2nd Street with minimal side-yard setbacks. The construction of a single- family attached house at 612 East 2nd is complimentary to the existing development. FINANCIAL IMPLICATIONS: There are no financial implications for the City. BOARD/COMMISSION RECOMMENDATION: The Planning and Zoning Commission, at their January 11, 2023 Regular Meeting, voted 7-0 to recommend approval. STAKEHOLDER PROCESS: The Planning Department sent out Notice of the Planning and Zoning Commission Public Hearing to all property owners located within 300 feet of the subject property. A Public Notice poster was placed on the subject property 15 days prior to the Public Hearing. ALTERNATIVES: If City Council does not approve this Ordinance the property will not be zoned in accordance with the Pueblo Municipal Code. Upon request of City Council, the Ordinance could be returned to the Planning and Zoning Commission for consideration of proposed modifications. RECOMMENDATION: Approval of the Ordinance.
