AN ORDINANCE AUTHORIZING FUNDS IN THE AMOUNT
OF $50,507.64 FROM THE BLACK HILLS ENERGY
UNDERGROUND UTILITY FUND TO BE EXPENDED FOR
THE ARKANSAS RIVER TRAIL, PHASE 4 PROJECT,
PL1606
WHEREAS, The Arkansas River Trail Upgrade and Safety Improvements Phase
4 Project, PL1606 has been established, and
WHEREAS, A total of $185,716.20 has been approved by City Council to be
expended to place existing overhead utility lines underground for the project, and
WHEREAS, Additional funds in the amount of $50,507.64 is required to cover the
increased cost to underground the overhead utility lines; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
Funds in the amount of $50,507.64 are hereby authorized and made available to
be expended from the Black Hills Underground Utility Fund to place existing overhead
utility lines underground for said project.
SECTION 2.
The officers and staff of the City are authorized to perform any and all acts
consistent with this Ordinance to implement the policies and procedures described
herein.
SECTION 3.
This Ordinance shall become effective on the date of final action by the Mayor
and City Council.

SUBJECT: AN ORDINANCE AUTHORIZING FUNDS IN THE AMOUNT OF
$50,507.64 FROM THE BLACK HILLS ENERGY UNDERGROUND
UTILITY FUND TO BE EXPENDED FOR THE ARKANSAS RIVER
TRAIL, PHASE 4 PROJECT, PL1606
SUMMARY:
The proposed Ordinance would authorize the use of the Black Hills Underground Funds
for the Arkansas River Trail Phase 4 Project. Funds in the amount of $50,507.64 shall
be expended on Project PL1606. The funds will be used to provide local match money
to a Colorado Department of Transportation (CDOT) grant, and underground
powerlines near the river's edge.
PREVIOUS COUNCIL ACTION:
Ordinance 9010, dated July 11, 2016, established the Arkansas River Trail Upgrade
and Safety Improvements Phase 4 Project, budgeted and appropriated funds in the
amount of $770,618.00, transferred funds in the amount of $65,887.00 from the
Conservation Trust Fund, Authorized funds in the amount of $88,237.00 from the Black
Hills Underground Utility Fund to be expended and approved an IGA between the City
and CDOT to receive grant funds in the amount of $616,494.00 for the Project.
Ordinance 9487, dated June 10, 2019, authorized an additional $69,292.00 from the
Black Hills Energy Underground Utility Fund.
Ordinance 9751, dated July 13, 2020, authorized an additional $28,187.20 from the
Black Hills Energy Underground Utility Fund, approved an IGA between the City of
Pueblo and CDOT to receive grant funds in the amount of $200,000.00 and budgeted
and appropriated $200,000.00 for the Project.
Resolution 15024, dated October 11, 2022, awarded a construction contract to
Merriman Land Works dba Flat & Fancy in the amount of $421,688.63.
BACKGROUND:
The Project is the fourth phase of the upgrade and reconstruction of the 25-year old
section of the Arkansas River Trail northwest of Santa Fe Avenue along the south side
of the Arkansas River. The Project will connect the bike/pedestrian trail to the south
side of the 4th Street Bridge, provide parking for trail users, and connect a trail access
from the nearest bike/pedestrian crossing west of the 4th Street Bridge to the Arkansas
River Trail.
Prices to put the overhead utility lines underground have increased from $88,237.00 to
$236,223.84 since the previous authorizations by the City Council were in 2016, 2018,
and 2020. In late 2022, Flat & Fancy was awarded the construction contract, to begin
construction in the "Spring of 2023." Once the funds are authorized for Black Hills
Energy to underground the overhead utility lines, the work can begin and no additional
increases are anticipated.
The cost to install lighting along the roadway will be paid for from the project account.
FINANCIAL IMPLICATIONS:
Funds in the amount of $50,507.64 shall be expended for the Arkansas River Trail
Upgrade and Safety Improvements, Project PL1606.

ALTERNATIVES:
Denial of this Ordinance will result in insufficient funds to place the overhead electric
lines underground.
