AN ORDINANCE APPROVING A MEMORANDUM OF
UNDERSTANDING BETWEEN THE CITY OF PUEBLO AND THE
NATIONAL LEAGUE OF CITIES INSTITUTION (“NLCI”),
APPROVING AND ACCEPTING A CITIES ADDRESSING FINES
AND FEES EQUITABLY (“CAFFE”) GRANT, ESTABLISHING
PROJECT NO. PS2302, AND BUDGETING AND
APPROPRIATING FUNDS OF $10,000 TO BE USED
CONSISTENT WITH THE MOU
WHEREAS, the National League of Cities (“NLC”) created the Cities Addressing Fines
and Fees Equitably (“CAFFE”) project and this project provides grant funds to cities participating
in the project;
WHEREAS, the City of Pueblo Municipal Court applied and was accepted into the
CAFFE project and the NLC has awarded it an initial grant of $10,000 to help support costs
associated with the initial planning phase of the project pursuant to the terms and conditions of
the MOU; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The Memorandum of Understanding (“MOU”) between the City of Pueblo and the
National League of Cities Institution, a copy of which is attached hereto, having been approved
as to form by the City Attorney, is hereby approved.
SECTION 2.
The Mayor is hereby authorized to execute said MOU for and on behalf of the City and
the City Clerk is authorized to affix the seal of the City thereto and attest same.
SECTION 3.
The CAFFE project grant award in the amount of $10,000 corresponding to the MOU is
hereby accepted and approved.
SECTION 4.
Project No. PS2302 is hereby established, and funds in the amount of $10,000 are
budgeted and appropriated therefor.
SECTION 5.
The Pueblo Municipal Court through the Presiding Municipal Court Judge is empowered
to apply for and accept additional supplemental CAFFE project grant funds as needed and
awarded.
SECTION 6.
All current and future funds accepted under this Ordinance shall be budgeted and
appropriated into Project No. PS2302 by the Finance Department.
SECTION 7.
The officers and staff of the City are authorized to perform any and all acts consistent
with the intent of this Ordinance and the attached Memorandum of Understanding attached
hereto to implement the terms and conditions described therein.
SECTION 8.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

SUMMARY:
Municipal Court is requesting City Council approve the attached Memorandum of
Understanding with the NLCI and accept the $10,000 grant offered with the
Memorandum of Understanding as part of the CAFFE project.
PREVIOUS COUNCIL ACTION:
There has been no previous City Council action with regard to this Ordinance.
BACKGROUND:
In July of 2022, Judge Sikes attended a roundtable event at the NLCI to discuss
municipal court fines and fees. Thereafter, the City of Pueblo Municipal Court was
invited to apply to participate in the CAFFE project. On November 9, 2022, Municipal
Court submitted its application to the project which was subsequently approved by
NLCI.
The one-year CAFFE project seeks to increase racial equity and economic mobility for
residents by helping cities mitigate the often-harmful impacts of municipal fines and
fees on residents’ financial health, while implementing innovative court sanctions that
provide restorative justice and accountability. CAFFE will provide municipal teams with
technical assistance, peer learning opportunities, and grant funding to achieve these
goals.
FINANCIAL IMPLICATIONS:
The MOU provides for a $10,000 grant to help support costs associated with the initial
planning phase of the CAFFE project. No matching funds are required. Additional
grant funds may be available in the future.

Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
Not applicable to this Ordinance.
ALTERNATIVES:
Decline to accept the MOU and associated grant funds. Municipal Court will withdraw
from the CAFFE project.
RECOMMENDATION:
Approve the Ordinance.
