A RESOLUTION AUTHORIZING PAYMENT FROM PROJECT
CI2113 - AMERICAN RESCUE PLAN ACT FOR THE
PURCHASE OF 718 W. 4TH STREET, PUEBLO CO 81003, FOR
PURPOSES OF PROVIDING AN OUTDOOR SHELTER FOR
HOMELESS INDIVIDUALS WHO WERE
DISPROPORTIONATELY IMPACTED BY THE COVID-19
PANDEMIC, AS AUTHORIZED BY SECTION 603 OF THE
AMERICAN RESCUE PLAN ACT AND U.S. TREASURY FINAL
RULE 31 CFR 35.6
RECITALS
The following recitals are incorporated in and made a part of this Resolution.

WHEREAS, 718 W. 4 Street, Pueblo, CO 81003 (the “Premises”) is located in a
Qualified Census Tract; and
WHEREAS, the building located on the Premises is currently vacant and abandoned
and requires demolition; and
WHEREAS, pursuant to U.S. Treasury ARPA Final Rule p. 134, ARPA funds may be
spent to pay “costs associated with acquiring and securing legal title of vacant or abandoned
properties and other costs to position the property for current or future productive use;” and

WHEREAS, 718 W. 4 Street near downtown Pueblo is adjacent to the Pueblo Rescue
Mission and current plans are to demolish the existing building to enable the property to be used
as an outdoor homeless warming shelter when temperatures are below 20 degrees and as a
shaded cooling location when temperatures exceed 100 degrees; NOW, THERFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
Funds in the amount of Sixty-Five Thousand Dollars ($65,000) plus applicable title
insurance and closing costs are hereby authorized to be paid from Project CI2113 American

Rescue Plan Act, for the purchase of 718 W. 4 Street near downtown Pueblo to be used as an
outdoor shelter for unhoused individuals who were disproportionately impacted by the COVID-
19 pandemic.
SECTION 2.
The officers and staff of the City are authorized to perform any and all acts consistent
with this Resolution which are necessary or desirable to implement the transactions described
herein.
SECTION 3.
Funds in the amount of Sixty-Five Thousand Dollars ($65,000) plus applicable title
insurance and closing costs are hereby authorized to be paid from Project CI2113 American

SUMMARY:
This Resolution authorizes payment in the amount of $65,000 plus applicable title
insurance and closing costs from Project CI2113 American Rescue Plan Act (“ARPA”)

for the purchase of 718 W. 4 Street near downtown Pueblo to be used as an outdoor
shelter for unhoused individuals who were disproportionately impacted by the COVID-
19 pandemic. This payment is authorized by section 603 of the American Rescue Plan
Act and U.S. Treasury Final Rule 31 CFR 35.6
PREVIOUS COUNCIL ACTION:
By Ordinance No. 9931, approved on May 17, 2021, the City Council established
Project No. CI-2113 and budgeted and appropriated up to $36.7 million in funds which
were expected to be distributed to the City from the American Recovery Plan Act
(“ARPA”) for covered costs and eligible expenses to be incurred during the period
which began on March 3, 2021 until December 31, 2024 (to be expended by December
31, 2026).
BACKGROUND:

The Mayor and City staff are recommending that the City purchase 718 W. 4 Street
near downtown Pueblo. The property is adjacent to the Pueblo Rescue Mission and
current plans are to demolish the existing building to enable the property to be used as
an outdoor homeless warming shelter when temperatures are below 20 degrees and as
a shaded cooling location when temperatures exceed 100 degrees. Contemporaneous
with this Resolution, City Council is being asked to approve an emergency ordinance

accepting and approving the assignment of a contract to buy 718 W. 4 Street.
FINANCIAL IMPLICATIONS:
Funding for this purchase will be paid out of Project CI2113 – American Rescue Plan.

City Council could decide not to authorize payment for the purchase of 718 W. 4
Street to be used as an outdoor shelter for the City’s homeless residents.
