AN ORDINANCE AUTHORIZING AMENDMENT NO. 18 TO THE
AGREEMENT FOR COMMUNITY SERVICES PLANNING,
ADMINISTRATION, AND ACCOUNTABILITY SERVICES
BETWEEN THE CITY OF PUEBLO, A MUNICIPAL
CORPORATION, AND THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF PUEBLO
WHEREAS, City and County have heretofore entered into the Agreement for Community
Services Planning, Administration and Accountability Services dated July 14, 2003, (hereinafter
“the Agreement”) wherein the parties set forth their agreement concerning cooperation in the
funding, contracting, and compliance monitoring of non-profit community service organizations;
and
WHEREAS, the parties desire to continue the cooperative arrangement for another
calendar year and it is therefore necessary and desirable that the Agreement be amended to
extend its term for an additional calendar year; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF PUEBLO, that
SECTION 1.
Amendment No. 18 to Agreement for Community Services Planning, Administration, and
Accountability dated December 12, 2022 between the City of Pueblo, a Municipal Corporation,
and the Board of County Commissioners of the County of Pueblo (“Amendment ”), for
community services planning, administration, and accountability services, a copy of which is
attached and incorporated herein, having been approved as to form by the City Attorney, is
hereby approved.
SECTION 2.
The Mayor is hereby authorized to execute said Amendment for and on behalf of the
City and the City Clerk is authorized to affix the seal of the City thereto and attest same.
SECTION 3.
The officers and staff of the City are authorized to perform any and all acts consistent
with this Ordinance to implement the policies and procedures described herein.
SECTION 4.
If any section, paragraph, clause, or provision of this Ordinance shall for any reason be
held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph,
clause, or provision shall not affect any of the remaining provisions of this Ordinance.
SECTION 5.
This Ordinance shall become effective on the date of final action by the Mayor and City
Council.

BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
PUEBLO
SUMMARY:
Attached is Amendment No. 18 to the Intergovernmental Agreement between the City
and the County of Pueblo, which provides for the administration of the Community
Services Advisory Commission (CSAC). This Amendment extends the Agreement until
December 31, 2023.
PREVIOUS COUNCIL ACTION:
The City Council has approved the extension of the Agreement every year since 2003.
BACKGROUND:
Prior to 2003, the City and County of Pueblo had separate processes by which they
allowed local non-profits to apply for general revenue funds. In 2003, the City and
County entered into an agreement that streamlined that process and created the
Community Services Advisory Commission. Under the Agreement, Pueblo County
administers the funding process. The Agreement is for one year, and it has been
renewed each year since 2003.
FINANCIAL IMPLICATIONS:
During the City’s budget process, the City Council determines the amount of funding
that it will appropriate for the Community Services Advisory Committee. There is no set
amount stated in the Agreement. In 2013, the City and County amended the Agreement
to allow for a 5% administrative fee to be charged, as opposed to a yearly negotiated
amount. In 2023, the City will contribute $490,000 and the County contribution will be
$465,500. The CSAC Agreement allows the County a 5% ($47,775) administrative fee
to administer CSAC.
BOARD/COMMISSION RECOMMENDATION:
There are no boards or commissions associated with this action.
STAKEHOLDER PROCESS:
There are no required or recommended stakeholder processes attached to this action.
ALTERNATIVES:
The City or the County could choose to return to the processes in place prior to 2003,
and each entity would undertake its own funding process.
RECOMMENDATION:
Approval of the Ordinance.

THIS AMENDMENT NO. 18 to Agreement for Community Services nning,
Administration, and Accountability Services is made and entered into this aQ • y of
December 2022, by and between the City of Pueblo, a Municipal Corporation (hereinafter referred
to as "City"), and the Board of County Commissioners of the County of Pueblo (hereipafter
referred to as "County").
WHEREAS, City and County have heretofore entered into the Agreement for Community
Services Planning, Administration, and Accountability Services dated July 14, 2003 (hereinafter
the "Agreement"), and prior Amendment No's. 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16,
and 17 thereto, wherein the parties set forth their agreement concerning cooperation in the
funding, contracting, and compliance monitoring of non-profit community service organizations;
and
WHEREAS, the parties desire to continue the cooperative arrangement for another
calendar year and it is therefore necessary and desirable that the Agreement be amended to
extend its term for an additional calendar year.
NOW, THEREFORE, in consideration of the foregoing and the mutual terms and
conditions set forth herein, the parties agree as follows:
1. The Agreement is amended by revising section 8 (Term of Agreement) thereof to
extend the expiration of the term of the Agreement to December 31, 2023, unless
sooner terminated as provided in the Agreement.
2. Except as expressly modified by this Amendment No. 18, the Agreement, including all
prior Amendments, shall remain in full force and effect. Any obligations remaining to
be performed under the original Agreement and prior Amendments by either party,
including but not limited to those relating to the services to be performed by County,
or the compensation payable therefore, are not waived or excused in any manner, but
shall be fully performed in accordance with the terms and conditions of the Agreement
as it existed prior to this Amendment No. 18.
IN WITNESS WHEREOF, City and County have executed this Amendment No. 18 to
Agreement for Community Services Planning, Administration, and Accountability Services as of
the date first above written.
