HomeMy WebLinkAbout04591 ORDINANCE NO. 4591 AN ORDINANCE AMENDING SECTION 16 OF CHAPTER 4 OF TITLE XI OF THE 1971 CODE OF ORDINANCES OF THE CITY OF PUEBLO RELATING TO THE DIS- POSITION OF IMPOUNDED ANIMALS BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, COLORADO, that: (Brackets indicate material being deleted; underscoring indicates material being added. ) SECTION 1 . Section 16 of Chapter 4 of Title XI of the 1971 Code of Ordinances of the City of Pueblo is hereby amended to read as follows: 11-4-16: DISPOSITION OF IMPOUNDED ANIMALS As soon as practical after the impoundment of any animal, notice of impoundment shall be posted in a conspicuous place at the animal shelter for 5 con- secutive days. If the owner of the impounded animal can be determined by examination of the animal ' s vaccination tag or from other identifying tags or markings, immediate notice shall be given to 5im7 said owner. Any impounded animal may be redeemed by the owner upon payment of the impound fee, care and feeding charges, veterinary charges, if any, and such other Lcosts7 charges as periodically set by the City of Pueblo. If the animal /1s7 has for rabies not been vaccinated/and is required by the provisions so of this Chapter to be/vaccinated, the owner shall not be given custody of the animal until steps are so taken to Vaccinate the animal. The following redemption amounts shall be charged: (a) For impounding any animal -- two dollars. (b) In addition, for /keeping] the care and feeding of any animal -- one dollar per day. If an animal is not redeemed within 5 days after the receipt of notice by the owner or within 5 days after impoundment if the owner /is not known7 cannot be determined, /by examination of the animal ' s vaccination tag,7 it shall be sold or deemed abandoned. A fee of $20. 00 shall be charged for any animal sold by or purchased from the animal shelter. If the purchased animal has not already been spayed or neutered, the purchaser shall be advised that one-half of the $20. 00 fee shall be refunded upon the furnishing of proof that the animal has subsequently been spayed or neutered. The shelter personnel may humanely euthanize /all/ any abandoned animals not sold within a reasonable time. If it /bel is found that any impounded animal /Ee7 is infected with rabies or other /infections7 infectious or contagious disease, such animal shall be humanely euthanized upon the recommendation of a licensed veterinarian. SECTION 2 . This Ordinance shall become effective immediately upon final passage and approval. If any section, subsection, clause or phrase of this Ordinance is, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. -2- ' I . SECTION 3 . Any person found guilty of violating any provision of this section shall be punished as provided for in Section 11-4-20 of the 1971 Code of Ordinances for the City of Pueblo, as amended.
