Additional funds in the amount of $391,593 comprised of $360,500 in 2023 Consolidated Planning Grant Funds awarded to the Pueblo Area Council of Governments (PACOG), and $31,093 in adjusted carry over funds from the fiscal year 2021 Consolidated Planning Grant are hereby budgeted and appropriated for the FY2022-2023 Urban Transportation Planning Project. SECTION 2. The officers and staff of the City are authorized to perform any and all acts consistent with the intent of this Ordinance to implement the policies and procedures described herein. SECTION 3. This Ordinance shall become effective on the date of final action by the Mayor and City Council. Gradisar VIA: Marisa Stoller, City Clerk FROM: Scott Hobson, Acting Director Planning and Community Development SUBJECT: AN ORDINANCE BUDGETING AND APPROPRIATING AN ADDITIONAL $391,593 IN PACOG FY-2022-2023 CONSOLIDATED PLANNING GRANT FUNDS FOR TRANSPORTATION PLANNING SERVICES RELATED TO THE CITY OF PUEBLO AND PUEBLO AREA COUNCIL OF GOVERNMENTS 2023 DELEGATION AGREEMENT FOR TRANSPORTATION PLANNING SERVICES SUMMARY: The proposed Ordinance will budget and appropriated additional Federal Highway Administration Consolidated Planning Grant (“CPG”) funds in the amount of $391,593 into the Urban Transportation Planning Project. The additional funds include $360,500 in FY2023 CPG funds and $31,093 of additional carry-over funds from FY2021 that have not been budgeted and appropriated by the City. The funds have been included in the City and PACOG Delegation Agreement budget and the PACOG Urban Planning Work Program budget. The FY2022-23 FHWA CPG Funds in the amount of $710,187.00 are identified for expenditure in the 2023 Pueblo Area Council of Governments (PACOG) Metropolitan Planning Organization (MPO) budget approved by the PACOG Board on August 25, 2022, Resolution No. 2022-016 PREVIOUS COUNCIL ACTION: Ordinance No. 10034 approved on November 8, 2021 established the FY2022-2023 Transportation Planning Project, and budgeted and appropriated $679,094 in FY 2022 Consolidated Planning Grant Funds. BACKGROUND: The PACOG Board approved a Consolidated Planning Grant contract amendment for FY2022-2023 with the Colorado Department of Transportation (CDOT) at their October 27, 2022 meeting. The contract provides funds in the amount of $360,500 along with estimated additional carry over funds from the FY2021 CPG contract in the amount of $31,093.00 that will be available for eligible reimbursable expenses. The City and PACOG annually enter into a Delegation Agreement that authorizes the City to complete the transportation planning tasks on behalf of PACOG and be reimbursed for eligible expenses to complete the tasks identified in the FY 2022-2023 Unified Planning Work Program (UPWP) adopted by PACOG Resolution 2022-016 on August 25.2022. This Ordinance budgets and appropriates an additional $391,593 into the 2022-2023 Urban Transportation Planning Project. The total two-year contract totals $1,070,687.00 in funds allocated for the City to complete urban transportation planning services for the FY2022 and FY2023 federal fiscal years in compliance with federal and state requirements for the use of the CPG grant funds. FINANCIAL IMPLICATIONS: Additional funds in the amount of $391,593 will be budgeted and appropriated for the Pueblo Urban Transportation Planning Project which includes $360,500 in FY2023 FHWA CPG Funds and estimated additional federal and local carry over funds from the previous years totaling an estimated $31,093. While the Planning staff costs and operating expenses will be reimbursed through the PACOG grant funds, it is estimated that approximately $1,500 in staff time from the Finance and Legal departments will be expended on the project. BOARD/COMMISSION RECOMMENDATION: The FY2022–FY2023 funds are included in the FY2023 PACOG MPO Unified Planning Work Program budget, and the Urban Planning Work Program that have been previously approved by the PACOG Board on August 25, 2022. STAKEHOLDER PROCESS: The Consolidated Planning Grant funds, approved by CDOT and the Federal Highway Administration, are identified in the Urban Planning Work Program (UPWP) by task with associated budget amounts. The UPWP is reviewed at public meetings by the PACOG Transportation Advisory Committee and approved by the PACOG Board. ALTERNATIVES: None. RECOMMENDATION: Approval of the Ordinance. ATTACHMENTS: 1.
