ORDINANCE NO. 10311
AN ORDINANCE APPROVING A LICENSE AGREEMENT
BETWEEN THE CITY OF PUEBLO, A MUNICIPAL
CORPORATION, AND THE COLORADO STATE FAIR
AUTHORITY, A SUBDIVISION OF THE STATE OF
COLORADO, AND AUTHORIZING THE MAYOR TO
EXECUTE SAME
BE IT ORDAINED BY THE CITY COUNCIL OF PUEBLO, that:
SECTION 1.
The License Agreement for Use of a Facility between the City of Pueblo, a
Colorado Municipal Corporation, and the Colorado State Fair Authority, a subdivision of
the State of Colorado, a copy of which is attached hereto "Agreement", having been
approved as to form by the City Attorney, is hereby approved.
SECTION 2.
The Mayor is authorized to execute and deliver the Agreement in the name of the
City and the City Clerk is directed to affix the seal of the City thereto and attest same.
SECTION 3.
The officers of the City are authorized to perform any and all acts consistent with
this Ordinance to implement the policies and procedures described herein.
SECTION 4.
This Ordinance shall become effective on the date of final action by the Mayor
and City Council.

SUMMARY:
This Ordinance approves a license agreement for the use of facilities at the Colorado
State Fairgrounds in support of a community clean up event scheduled to be held on
October 29, 2022.
PREVIOUS COUNCIL ACTION:
None.
BACKGROUND:
The City of Pueblo will be executing a City-wide clean up event to be held on October
29, 2022, at the Colorado State Fairgrounds for the benefit of City of Pueblo residents.
The Colorado State Fair has requested the City enter into a license agreement for use
of the facility to host the event. All fees associated with the use of the facility have been
waived under the terms of the license agreement.
FINANCIAL IMPLICATIONS:
None.
BOARD/COMMISSION RECOMMENDATION:
Not applicable to this Ordinance.
STAKEHOLDER PROCESS:
Not applicable to this Ordinance.
ALTERNATIVES:
If this Ordinance is not approved, the City of Pueblo will not be able to host the cleanup
event as planned at the State Fairgrounds.
RECOMMENDATION:
Approval of the Ordinance.

hereinafter known as the LICENSEE.
WHEREAS, the FAIR agrees to rent the LICENSEE, where is, as. is, CAPNiVAL i OT (known hereinafter as the P-?EMISESi located on the
Colorado State Fairgrounds for the purpose of COMMUNITY CLEAN UP EVENT(The "Event').
the Fair grants User the use and occupancy of the Premises for the following RENTAL PERIOD

Time of Event: 8:00 AM TO 3:00 PM
Authorized MOVE IN period: 8:00 AM to 7:00 PM on FRIDAY, OCTOBER 28,2022
Move-Out Period: BY 5:00 PM MONDAY,OCTOBER 31,2022.
Authorized Occupancy: Licensee shall have access. to the Premises on dates and tam es lister above only. Authorized occupancy on
event duy(sj only shall oe 07:00 AM to 7:00 PM, The Rental Period shall not be extended tor any purpose without the written
permission of the Fair's General Manager. User agrees to nay For any additional period of time in excess of the Rent al Period.
Now,therefore, in consideration of rental price as follows.
RENTAL FEE:WAIVED-INCLUDES RENTAL PERIOD ABOVE.
DAMAGE DEPOSIT: WAIVED
ADDITIONAL MOVE-IN/MOVE-OUT FEES: WAIVED
SET-UP/CLEAN-UP FEE: WAIVED-CUSTOMER TO PERFORM SET UP&CLEAN UP.
ADJUSTABLE CHARGES: LICENSEE is responsible for setup of tables and chars unless noted above. Additional tables and chairs may
be rented front :he FAIR should building capacity allow Additional equipment fides are SE 00 per table and 51.(10 per chair
Setup/clean up fees of no less than 5350 per occurrence will be charged if FAIR is recuired to perform setup and/or cleanup.
SECURITY: _icensee is'coon-ed to use State Fair Security at a rare of up to 527.00 per guard per hour and up to $35.50 per
uniformed police officer per hour. Number of security guards end/or uniformea police will be determined by security director and
FAP Management.
FOOD&BEVERAGE: Licensee may use caterer of choice for catered meals inside the facility; however at caterers must he pre-
aporoveo by FAIR management Alcoholic Beverages may be served during your event: however, the SALE of alcoholic beverages is
prohibited the SALE of food or beverage is prohibited without approval`rem the FAIR All concessions(sale of food or beverage)
for events must be coordinate through the FAIR and ail concessionaires rrv,ist. enter into a separate contract with the FAIR.
This signed contract is due back to the FAIR in ten (10)days with first payment to hold building_ The LICENSEE will notify FAIR
fourteen (14)days in advance of event set-up.
The LICENSEE agrees to make payments and final settlement as follows: No payment due with signed contract,all rental fees
waived.
An additional$0,75 and 2.25%service fee will be applied to the transaction amount for all credit card payments.
F AiR will charge and LICENSEE agrees to nay one and one-half percent(i.S%)per month interest on any unpaid balance after
settlement date.
